I was issued a citation for Failure to Wear A SeatBelt.
State Patrol issued it. It was really a BS deal, as I was the passenger, it was night, and he passed us going the other direction. Not to mention that it was going around a blind corner.
I beat the ticket, but here is what bothers me.
The law has been changed for Speedy Trial. It used to be 90 Days from the time of citation. They changed it this year to 120 Days. Also, the officer, while he doesn't need to show up in court, no longer needs to write any supporting affidavits, just what he writes on the citation slip. This, pretty much well, leaves me no recourse to argue the facts.
Luckily, the judge could see the wisdom of my argument. I still think its BS to charge me a days wages for not wearing a strap of nylon that had no function in that particular event. It was purely revenue collection, with no basis in common law.
