Not until, or unless a specfic state get's involved. How do you legally declare war on non-state organizations? That has been the principal concern for both the president and congress.

They could declare war on the terrorist organizations, but that would open up other cans of worms. If you capture one, are they a POW, and therefore unable to be prosecuted and thrown into civilian jail?

Since most insurance companies are not liable for acts of war, would declaring war make them exempt from their liability and if so, would that keep the government from wanting to declare war?

Once war is declared on a particular group,they technically become soldiers. But then they are bound by the Geneva and Hague conventions on the conduct of war. Then mcgredo is right,they cannot be prosecuted in a civilian court. They most certainly can be prosecuted in a military court martial.
Deliberately targeting and killing civilians is a war crime. Once convicted in a much swifter,straight forward court martial, lots of unpleasant things can be done to them.

Because as has already been said, I don't think that we will declare official war. We are not fighting against an enemy with specific borders.  The enemy is scattered and somewhat hard to define as to actually who.  I feel that this will be a long battle.

drjimbob, you've got it right.  A declaration of war would eliminate insurance company liability.
I've heard this mentioned somewhere/sometime since the terrorists attacks - something like "If the European re-insurance companies try that stunt this administration will go ballistic."
