Here's the deal: My wife and son just went shopping at Wal Mart and bought among other things a DVD movie. The check out person forgot to deactivate the pilfer alarm insert in the movie as she rung the items up. As my wife was pushing the cart through the exit door the alarm went off. The door guard forcefully grabbed her cart and pulled it away from her saying "I have to check your receipt against the items in your cart."

Here is the potentially serious problem, my wife has severe Multiple Sclerosis and is legally and obviously disabled. She normally uses a cane and an escort's arm to walk, but she uses a shopping cart to steady herself while shopping. When the lady grabbed and pulled the cart she would have fallen if my son hadn't grabbed her.

I have already spoken to the manager and let her know that this is unacceptable and asked her to educate all of her guards not to physically grab a cart away or they could cause injury. The manager gave me a sincere apology and promised to talk to the person involved.

I am not the sueing type, and this incident has been dealt with to my satisfaction. I am asking what you would have done so I can be prepared in case it ever happens again. Please keep it civil!

Its definatly against Walmart policy to grab anything.

I have been through the first part of door greeder training and it is stressed very much to approch the customer clamly and friendly, and to never grab them or the merchandise or accuse them of any thing.

I think you handled it in about the best possible manner.

Only thing I would have asked is for a written appology from the door manager that grabbed the shopping cart. At least that way you know the store manger spoke with this person, and that they invested time in thinking about and formulating an appology (even if it isn't sincere).

Don't shop at Wal-Mart, or if you do, make sure they deactivate all your stuff.....I had a simular thing happen to me, except my kid was in the cart when the old fart grabbed it. HE GOT AN ASS CHEWING......

As i see it, once i hand over payment for the items, they are in turn mine. Anyone wanting to search my stuff will have to have probable cause and a LEO on the scene or they can ge to hell. Ive on many occasions let a wlamart door checker know my opinion. i do not stop, even when asked to. If they have me on video stealing, they had better provide it if they want to search my bags.

God forbid, if your wife would have taken a fall because of this thoughtless person ....... well, it would be a monumental challenge to control my temper in that scenario.

Let's face it, your practical options are fairly limited in this situation. I think you handled the situation well and did the right thing.

In my civil mindset, I would have pulled out my FOX and would proceed to unload the cannister at the receipt checker's face.

"The price is wrong, bitch!"

Then I would've spray painted OWNED! on their back.

Oh, I guess what you did was fine. You received a sincere apology from the manager and the manager said they would deal with it. I wouldn't see a reason to take it any further.

OTOH, I always have my receipt out when leaving WalMart, and they never even ask me to see it. Gosh!

Wal-Mart door greeters/receipt checkers are usually the lowest common denominator. They can barely stand and do their job, while their drool obscures your receipt. Now that is a bio-hazard.

I'd want employees actively looking for possible thefts.....sorry your wife has an ailment, but I wouldn't want my employees "gunshy" when confronting suspicious circumstances....luckily the VAST majority of people confronted by employees prob do not have an ailment that requires physical contact with a shopping cart so it's a pretty rare occurance to expect a company to address directly....

I bet the ADA would disagree with you on that. I agree with you on theft deterrance, but I would want my employees to perform their duties sensibly and keep my legal exposure to a minimum.

Everything in and around Wal-Mart is videotaped I'd be on the phone with an Attorney like right-now. This Jacka$$ that did this should be fired. I WOULD SUE. What if he had injured her......What about the next time he does this to a kid or an old lady and he hurts them just because he thinks he's some kind of enforcer. Just takes one incident. With WalMarts press lately you might have a salivating jury. But I'm with you on your first sentence. My daughter has a 2nd job at Anthropologie. They got ripped off by a woman who is a "friend' of the manager! Figured it out after she left. I hate thieves.

I wouldn't let them off that easily. Call corporate and raise hell. Trust me the idiot who grabbed the cart and the entire management staff does not want that kind of attention.

Who knows you could get a permanent up fron reserved parking space and nachos for life , or mcdonalds or ???

Regardless I wouldn't let any of them off that easily.
Next time somebody could get hurt and it could be your wife or you.

Sad.

If the alarms go off on me I just shrug and keep walking figuring if it was important they'd have removed/deactivated the tag or would come chasing after me but I'm not going to waste my time wandering around trying to find someone to fix their mistake. I get alarmed about once every few years and have now started paying attention when buying DVD's that they rub the sensor over the area to deactivate them until they get a confirmation beep.

If they go off on your wife she should just stop and turn around holding onto the cart for support.

try this on for size --- the other night my girlfriend and I had just finished buying up some groceries at wally world, and after we check out, she without thinking tosses the receipt in the trash. Usually they don't check at the door at my local walmart, but with my luck ofcourse they decide to check this time. Long story short, we had to go get the cashier, who verified that we had indeed paid for everything, but that wasn't good enough for the door nazi, so the manager had to come out, and cross reference everything in our cart with a second print out from the cashier before Ms. Hitler at the door was satisfied. All in all, Wal-Mart sucked up about 30 minutes of my time, and I value my time!! h.gif

I'd call home office and let them know. The manager may take care of it properly, but I have seen some managers just say "Don't do it again". When home office calls and wants to know what actions were taken to insure this doesn't happen again I guarantee things will get done. I'd seriously give them a call, even if you just call the district office. What if this person does the same thing again and somebody does get hurt.....

I'm not a lawyer and I know you can sue anyone for anything. But I don't see how you could win anything if you did sue. I would think you'd have to show some sort of loss/damage/injury. Just saying something could have happened wouldn't cut it IMO. If she had fallen it would be a different story.
