To keep the playing filed level lets make it 21yrs old, .08% BAC and based on a simple traffic stop not a traffic collision.

Here its $370.00 fine, 90-days restricted license and AA classes/MADD board.

No idea what it is since I havent and wont ever find out personally.
Whatever it is, it isnt harsh enough to discourage the act effectively.

Up to 7 days in jail, 90 days license revocation, $500 fine

But our judges normally give 12-15 months probation, $500 fine, require AA meetings and counseling, and have the DMV's automatic license revocation count for the court-ordered revocation

Our county also offers a diversion program for first time DUI's - it costs about 5 or 600 bucks, consists of counseling, testing, and a bunch of other hoops to jump through. Successful completion wipes it off your record. If you screw up within a year though, they can come back and charge you with the original.

What happened to the potential 30 day sentence, 2 days minimum?

Dont know. The above is based on 30 DUI convictions I checked up on in 2005. Some plead out, some were found guilty by a jury.  all got the sentance i listed above.

Guilty plea?

Usually falls around a 250$ fine(can be deferred or make payments), Alcohol remediation, 6 months unsupervised probation. (no jail time beyond booking) Some judges the fine goes up a bit, but that's about it.

IIRC, $500 to the court, 6 mos suspended DL, 1 year suspension if you refuse to blow, also paying for the classes. Total for one of our dispatchers wound up being ~$3500 and a "work only" DL.

Most states talk real big, but we've got multi-multi-offense drunks still out driving around.

Locally, we just had an 11-time (yup, 11 convictions) drunk slam into a car full of college students.  Two of three students died.  The drunk is in jail now facing his 12th drunk driving conviction.

For 0.08% on a 21yr old in a non-accident?  Little extreme, isn't it?  0.08% is 2 beers in a half hour.

I'm thinking it's more like 5 beers in a half hour, but that penalty is still a little extreme

2 beers in a 1/2 hour isnt the problem....driving afterwards is.
I know some people have a high tolerance....others dont.
Because its subjective, there is no point in setting arbitrary values to descibe a concepts like 'legally drunk'. You may be able to drink 5 beers and retain the motor skills I demonstrate with only one in my system.....regardless, neither of us should be driving a motor vehicle on a public road.

While Im not advocating summary executions for being publically intoxicated, I have no problem with it in cases where innocent people are injured as the result of some drunk assholes negligence.

An 80# woman who drinks two beers in an hour is only a .056%.

A 180# man who drinks a 6-pack in 3 hours is only a .068%

A 165# man who drinks 7 beers in 3 hours is a .097%

A 162# man who drinks a 6-pack in 3 hours is a .075%

If you're an adult man, stay at the bar 3 hours and drink less than a 6-pack you will be well under a .08%

I think $370 is a little low.  I have been told it is closer to $2,000- $3,000 for a first offense.
It is a Misdomenor, so "potentially" someone in California could get up to 1 year in County Jail.
You would also have to attend classes, lose your license and pay some court costs.

Those are actual sentances from my DUI arrests.  I keep a long of arrests, filings and convictions for court.  so i check on everyone of my cases.

Those high estimates of the costs include things like attorney's fees and increased auto insurance rates.

Yep.  sounds like those pamplets MADD hands out.  They include an estimate of what a DUI conviction/arrest will cost you.  they include stuff like toing/impound fees, lawyer fees, DMV reissue fees, insurance rate increases, ect. Not a true picture of what the actual sentance for first time DUI coonviction is.  Its a exaggeration/worst case scenario intended to scare you into not drinking and driving.

As a county parole officer, I've been keenly aware of the DUI laws in PA.

If one is a first time offender and have no prior convictions, one is eligible for the ARD(Accelerated Rehabilitative Disposition)Program and it works like this: One agrees to complete the legislativelyy-mandated Alcohol Safe Driving School and any other recommended treatment, 50 hours of community service, and pay fees and costs, which is determined by the BAC. The license suspension is also determined by BAC, ie: 30 days if the BAC is under .16% and 60 days if the BAC is .16% or greater and no license suspension if the BAC is under .10%. If one completes these requirements, one's record will be expunged, however if these requirements are not met, one's case goes back on the trial list.

If one has a prior record for a misdemeonor or felony and this is the first DUI within a 10 year period one can get 6 months' probation if the BAC is below .10%, however if the BAC is .10% or above then one will get sentenced to a term of incarceration for 72 hrs with 6 months of parole or if one can offord it and if one is statutorily eligible for it, one will get a term of intermediate punishment for 6 months with 18 days on house arrest. The license suspension is one year for people who had a BAC of less than .16%, 18 months if greater than or equal to .16% and no suspension for under .10% BAC

As Far as costs go, and ARD case will cost one about $1500 and a parole/IP case will cost one about $2000.

I hope this has enlightened you all.
