Ok I read where a country singer got arrested for a bunch of stuff including guns and not having prescription drugs in the original container.

I take 6 ( hell I had to go count to see for sure how many it was) different prescription drugs EVERY day.  This has been ongoing for almost 5 years. (it is heart medicine)

I usually keep them in a seven day container so I can remember whether I have taken them for the day. Believe it or not it is DAMNED hard to remember sometimes.

This is illegal.......WTF???

Can I get in trouble for this?

I've heard of people being busted for having prescription drugs without a prescription, then again I've heard that prescription drugs arent illegal because the only illegal drugs are the "schedule" drugs which are the drugs that most people think about when they think about this whole war on drugs bullshit.

So whats the real deal.

Also how does the whole going to Mexico to stock up on prescription drugs fit into this whole thing, because I always hear about people going to Mexico to stock up on thier prescription drugs for cheap.

Why can they go to Mexico and buy a few months worth of prescription drugs down there, but they cannot here?

IMO anyone should be able to buy whatever they need OTC, none of this prescription bullshit, alot of times its just adding another middle man to the whole thing. Got to pay a doctor XYZ for his fucking signature.

I do not know about schedule 3 and below, but schedule 2 drugs must legally be kept in their container, thus establishing your "right" to have them.  To do otherwise is to invite Johnny law to do his thing, should he want to.

Check your state laws.

In my state only controlled substances are banned by B&P 4060.  meaning anyone can have any quantity of Rx viagra, amoxicillin, Ibuprophen ect.  but for controlled substances like Vicodin, oxycontin, methadone you must have a prescription. there is not state law that says you have to carry them in the original bottle.  However if the cops have probable cause to believe you do not have a current prescription you can be ticketed or booked into the jail overnight.

Like everyhting in LE its the totality of the circumstances that will determine if you are arrested. Vicodin in a pill despensor is unlikely to be a problem if you know who prescribed it and why.  The same vicodin carried in a melted shut cellophane wrapper from a cigarette pack and a $4.00 price tag attached and you'll probably go to jail.  That same vicodin in a bottle with some aspirin and you tell the cops its left over from a root canal two years ago, you'll probably get a ticket.

There is very little in CA drug laws that are remotely close to TX law. You can start with the fact that you cannot receive a citation for drugs in TX and move on from there.

Since when do you need a prescription for heroin, vicodin, cocaine, pot or LSD.  They are as close as the nearest street corner or high school.

My wife takes a "schedule" drug.  What a pain.  I haven't found a pharmacy other than the local hospital (but the local hospital doesn't accept Golden Rule) that will let me pick-up her prescription.  So, I have to drag her out of the nursing home every month (yes, each month since they won't give her more than 30 days of it!) to go get it.  I've been told by the city's uniformed patrol captain that if I'm caught with the drug on me or in my car without her, that even if it is in the packaging I will go to jail.  Nice world we live in.  It's all about making money for the doctors and the lawyers.z

used to be a pharmacist. supposedly even aspirin (in GA) not in a container is a violation of law and you can be arrested.

also someone said you cant have someone elses meds on you . Give me a break. if they are properly labeled and you are delivering them (think of nurses picking up meds for a nursing home. happens here all the time) they cant arrest you.

but the mislabeled or unlabeled stuff is true. you take your meds and put em in another bottle and you are breaking the law...

The Mexico thing is a barrel of worms.  Although one can probably make a case for excess profits on some parts of the picture. But if it is the same thing made by the same people using the same basic ingredients and same quality control, then the only difference is the distribution channel?

Another part is that there are some drugs that are prescription here and not there and people buying there are taking a risk bringing them back because  1. they don't have a prescription here and are self-medicating., and 2.  Smuggling.

Again, you are taking a real chance with getting look-alikes in Mexico.

If you don't have a choice because you didn't somehow get a drug plan in your retirement, and you KNOW that you are getting the real thing, It might be worth it.

Now in Canada the drugs are the real thing and the cost is because the .gov is subsidizing.  Now how long that will last is open to speculation.  How long witll the Canadian .gov and taxpayers want to sbusidize drugs for states here in the states that are going to want to buy in bulk up there?  I would bet that neither the pocketbooks or manufacturing/distribution system can stand it.

My wife gets horrible migraines. Whenever she gets a script for a painkiller, I usually pick it up on the way home from work. I've never heard of having to get your own perscriptions filled. In '98 I had a bad car accident, and my wife got a few (3 or 4) orders of "the good stuff" filled for me.

Move to a free state.

Easier to get than albuterol, flonase etc.


Lets not forget that primatene, which is harsh and can kill you, is available OTC, yet albuterol, which is milder and more effective (probably safer too), is prescription only

Most of my doctors will fill most prescriptions over the phone without a office visit as long as I've had a visit somewhat recently (~6 months).

I believe you are wrong on the texas law, I think you still canbe cited/ticketed for simple possesion in Texas. but i have been wrong before.

It's not enough that you get your meds paid for, now you want the docs to work for free.  Well, fuck you.

If it's a patient I've seen before and it's just a refill, no problem.  By law, you have to see a patient at least once a year if you are prescribing non-scheduled medication to them.  This makes sense since you should really check a TSH once in a while if you are prescribing Synthroid.  I usually write enough refills for a year for non-scheduled drugs.  It saves hassle for both me and the patient.

Less than 2oz is a Class B Midemeanor. There are no citations for Class B in Texas.
