FoxNews just had it.  Still not enough to overcome some chickenshit filibuster if they try it

Salazar or Colorado this AM said he will vote against Alito, but will joint the "group of fourteen" in precluding a filibuster.

Do we know when the vote is going to be yet?

Some Dems are saying that they won't filibuster:

"Because we have such a full plate of pressing issues before Congress, a filibuster at this time would be, in my view, very counterproductive," said Sen. Mary Landrieu, D-La., who wants the Senate to concentrate on Hurricane Katrina rebuilding programs. "We simply cannot afford to bring the Senate to a halt at a time when we need its action the most."

sydney7629: I'm not sure if the Dems want to try to filabuster, because this is an election year, they look kind of stupid even thought the Dems have the backing of most the USA news media.  The USA news media has lost a of their prestige in the past few years, now when the news media says "jump," most people will ask why, find the correct answer on the internet.

Yeah, I thought he might wind up being a moderate dem, but he's fallen right in with the most liberal wing of the party.   And he'll pay for it next election.

Sighhhhhhhhhhh.....

Ginsburg, Stevens, Bryer, Kennedy and Souter are still the majority and still control the Court.

The Dems haven't even BEGUN to fight. Just wait and see if GWBush gets a chance to replace one of THOSE Justices with a conservative - then you WILL see a filibuster, and no "gang of 14" will stay together to stop it.

What does this vote mean? How many against him?

It's Alito's confirmation vote by the full Senate.  If he passes, he's on the Supreme Court.  Apparantly 43 against him and 57 for him.

What amuses me is how the dems screech about the President "packing the court" in such a way that will take everyones rights away when even with Alito, the conservatives are still the minority on the court.

They're just warming up.

It means he'll be confirmed but if there is a fillibuster (highly unlikely) it's not enough votes to stop it.

They have the votes to stop a filibuster… 51 votes is all it takes to change Senate rules. That is why a filibuster not likely.

It really is a 6-3 liberal court right now, with the minority sometimes picking up Kennedy or O'Conor to lose 5-4.  At least with Alito, we can win 5-4 when Kennedy occasionally has some sense.  So things will be a bit better.

Stevens is 85.  The tide will really turn if we could get a good replacement for him.

Hell, even replacing Stevens with a flip flopper like O'Connor would be a significant step in the right direction.

Especially after what FDR did.
