Law Group Opposes Gunmaker Lawsuit Immunity

CHICAGO (Reuters) - The American Bar Association on Tuesday passed a resolution
opposing state and federal legislation that would protect the firearms industry
from civil lawsuits.
The resolution, introduced by the Los Angeles County Bar Association, was in
response to legislation pending in Congress that would strip courts of
jurisdiction to hear civil claims against gunmakers.
The legislation is similar to bills enacted in 19 states in the last two years
creating a special immunity for the firearms industry from claims brought by
government bodies. Five states have also passed laws protecting gunmakers from
suits, including those brought by individuals, on negligence or nuisance
theories.
There are a dozen lawsuits by California cities and counties, including Los
Angeles and San Francisco, that are set for trial in San Diego.
``The American Bar Association should approve this proposed recommendation
because the ABA continues to support stronger -- not weaker -- legal
responsibility and accountability for public safety by gun manufacturers and
dealers,'' the Los Angeles County Bar said.
The Los Angeles bar said these legislative proposals took the power away from
courts to determine civil claims against a single industry ``with a great deal
of political clout'' while liability was preserved for all other industries.
``There should be uniform agreement that it is up to the courts to determine
whether the gun industry or any other industry is liable under applicable state
common law with the context of a given set of facts,'' it said. ``There is no
legitimate reason why this industry should be exempt from the same common law
principles that govern all other industries.''
On Monday the California Supreme Court ruled that gun manufacturers cannot be
held responsible when products are used to commit crimes.
The court overturned a state appellate decision that would have opened the way
for victims of gun violence to sue manufacturers for the harms their products
caused. The case grew out of a 1993 shooting rampage at a San Francisco high
rise.

Fucking kalifornia lawers!!! What a suprise.  Ford, GM, Daimler-Chrysler and all auto manufacturers should be held responsible for all accidents involving a drunk driver because if the car was built with a breathalizer alchohol related accidents would not happen.  Oh, and all alchohol companies should also be to blame because if thier alchohol products didnt get people "drunk" there would be no accidents either.  And all mothers and fathers are responsible for every stupid child born that does stupid things when they grow up so all parents of murderers are at fault as well.  Why will no one take blame for thier actions???  If for some reason, whether insanity or not, I shoot someone it is not the guns fault, or the manufacturer of the guns fault.  Ok, so we take away all the guns. What about knives? They seem to work well in schools in Japan! Everyone needs to sit back at look at the person who uses the tool, not the tool as the cause!!

This is precisely why I was a member of the ABA for only about twelve months.  After reading what the ABA supported back in 1980(!), I made the decision never to support that 'commie' bastard group again!

What they've done since 1980 has only confirmed to me that my original decision was correct!

AMEN ! We have an idiot for a mayor in New Orleans who tried to bring a lawsuit against Gun
Manufacturers. He needs to go back in dealing in drugs or whatever he did before being elected so he could "Feed in the Public Trough". Whoops ! Doorbell just rang, was UPS

Of course they are opposed.  They are an industry advocacy group.  It is as suprising as oil companies opposing moratoriums on drilling, or ranchers opposing limits on grazing.  Every group will oppose limitations on its ability to make money.  The ABA hasn't met a liability limit law that it's liked yet, and probably never will.  What really pisses me off is that they (thow in AMA and teachers union too) act like some kind of damn social advocacy group, like they were the March of Dimes or something.

I forgot oil companies are at fault for all accidents because they provide feul for propulsion and lubricants to keep motors running.  I hope i dont forget anyone who is at fault but im sure thats my parents fault so I must blame them too.

The ABA can absolutely kiss my ass.  And I am a lawyer too!

They send me solicitation once in awhile to joing their F'ed-up organization, and I gladly write a note to tell them that their anti-rights anti-freedom positions on everything makes me "just say no."  Then it goes back to them in one of their postpaid envelopes so they can read my bitching about them at their expense.

Funny thing is I haven't heard from then lately . . .
