Sounds like a former FFL selling off his old inventory maybe, could be from a his own private collection though. Are FTF sales still legal in MA ?

So, is this a matter of an FFL losing his liscence and selling off his excess inventory or is it a matter of FFL loses liscence and keeps doing business anyway? Hell, it could just be his private collection. I know a few people who would laugh at how small a 90 gun collection is.

These are FEDERAL charges, not state charges. Whatever happened with this guy could happen in Texas or Nevada. |

That one asshole should be horsewhipped for carrying those rifles like an armload of firewood. It'll be be interesting to see whether the guy they arrested was rotating inventory or selling off his private collection, how many sales he made, et c.

The weapons they are testing are probably FAL-style rifles. We had one (FAL clone) that the selector switch would move from safe to fire, then continue to rotate to a thrid position. ATF guys wanted to make sure it wasnt select-fire.

Just because the guns you sell come from your private collection doesn't mean they can't bust you for dealing without a license. The laws are so vauge that no one knows what is considered dealing and what isn't. If the atf gets a bug up its ass for you, your going down. And you may beat the rap but you will never beat the ride.

Last I knew, he had an FFL. Shotgun News shows him as having an FFL, but his webpage, www.weareguns.com, hasn't been updated since August 2005. Perhaps he lost/failed to renew his FFL, but in either case, he should have know better.

FTF guns sales are legal in MA but there is a state imposed 4 gun limit per calendar year unless you have an FFL. The sale also requires the seller to file a form with the state declaring the sale. |

Almost all FALs have a full auto selector switchs. All they have to do to check the weapon is open it up and look to see if it is cut for a safty sear. Should take all of 10 seconds to do that. |

This really pisses me off. I've not worn the uniform of my country for the last twenty years or am deploying away from my family for the next 9 months to foreign lands so low-life, ATF, gestapo types can s--t all over the bill of rights while I am gone.
I support LEOs, but ATF are scumbags who's sole purpose for existing is anti-constitutional and anti-individual freedom. |

Can't argue about that, but he carried a lot of stuff, and the website was constantly being updated, and when he had sales, his prices were very good. He started pretty small, but was soon doing a pretty good business, and quite a bit of out-of-state sales and transfers. Its not like he was some old guy getting rid of his collection and not knowing the laws. He was very familiar with laws, including the state laws restricting personal sales to 4 per year without an FFL. I never got the impression, or heard anything shady about his operations, so there has to be something else going on here that hasn't been disclosed yet. |

I noticed that. Also, the judge told him to go home and bring his CCW pistols to the local police chief until the matter is cleaned up. If the judge thought this guy was such a monster, I don't think he would've left it up to the guy to transport the handguns. |

I'm sure they will be found to be so...use ammo with soft primers, inflict some wear on the internals, strap it to the bench with a rube goldberg contraption, and the rifle will be found to double or triple, thus making it an MG. If that doesn't work, they can always charge him with constructive intent if he owns any shoelaces. |

I know a LOT of guys who do this.
They get a FFL and at the end of 3 years quit and still have a shitload of guns. Some even order a bunch in the last month of being a FFL. Then they sell them as if nothing bad is going to happen to them. |

Not my point. Now that I read what I wrote, it came across as disparaging when I really meant to make the point that it's not really quite so Black & White. For that, I apologize. I was simply too tired to more eloquently and clearly express myself. Let me rectify this lapse in tact now. If it were so simple as "Black and White - Live Free or Die!" then all of us gun owners would be dead from raising our arms against the government as it slowly increases the strangle-hold of restrictions on our rights. More articulately - living under the rule of such a Socialist-agendized, Politically Correct government as found in California (hence the pejorative, "Kommifornia"), you can't afford to take such a myopic, singularly driven stance such as "Live Free or Die," as you would immediately be crushed by the existing brute of system that is already in place to infringe upon your rights. I completely agree, the only effective way to change the system is incrementally and by undermining the existing ineffective flotsam of laws and regulations that make living in California so difficult. One can only hope that your incremental restorations of personal rights accumulates more quickly than the gun-grabbers can pass more infringements . And for the record, if it were as Black-and-White as "Live Free or Die!" I would be dead right along side you. I lived in the Bay Area for 19 years, and my family has been in Mountain View since 1907 (I was born out of state while my parents were in college, but grew up in California since the age of 4). I was even in Berkeley for the last 4 years I was in the state (you want to see a FUCKED up Socialist hippie experiment destined to fail? Go live in the University Students Cooperative Association - what an eye-opener!). As soon as I had the facilities about me to understand how fucked California's laws are, my wife and I left to make a life for ourselves in a place that still respects our individual rights. So in the technical sense, I guess I'm doing exactly as Gunplay says; instead of dying in California, smothered by all the assinine restrictive legislation and the oppressive overpopulation, we're Living Free in beautiful Nevada |

The reverse seems to be possible as well. I have a friend who has a C&R license, but his vendors seem to sell him whatever he asks for. So far on his "C&R" he has purchased through the mail: Ruger Security Six in .357 Mag., S&W Model 29 w/4" (commemorative model), S&W 25 Mountain Gun in .45ACP w/4", etc... Oh well, it's not like he's going to run amock and kill anybody. |
