I grew up with a guy who was really into martial arts.  Yes, his name was Charlie or Chuck.  He took to numchucks like a duck to water and use to demo his fancy moves in schools and in parks where the girls would all swoon over him.  Later in life, he would marry one of these groupies which was a fox and half.  The fox apparently was more than he could handle and soon he was getting in fights with would be suitors of his wife.  Three times he beat the living daylights out of guys that started fights with him using his trusty numchucks.  Three times I advise the guy to buy a gun and be quiet about it.  

Well one day he sees his wife in the city park necking with a notorious pimp and drug dealor.  He pulls beside them and gets out with his trusty numchucks in hand.  Mr. Pimp Drug Dealor, didn't put his car in reverse and back out, he didn't run away, but simply stuck his nine millimeter out his window and blew poor old Chuck away across Chucks car.  Poor old Chuck's trusty numchucks hit the ground before his dead body did.  

Charged with voluntary manslaughter, Mr. Pimp Drug Dealor became Mr. Christian and his rap sheet as long as your arm not admissable and anyone who knew his name dismissed from the jury.  Meanwhile over a dozen witness were paraded before the jury telling of the prowess of poor old Chuck and his trusty numchucks.  Mr. Pimp Drug Dealor beat the charges once again and the cost of his trial Mrs. Chuck repaid in services.  

Poor old Dumb Chuck!

True story.  

Do you see the lesson?   Here's a hint.  It isn't just not taking a stick to a gunfight.

Sorry for old Chuck but the pimp was justified.  A reasonable person in that situation would believe they were in imminent danger of serious physical injury. The fact that he was a scumbag is not relevant.  He was not doing anything to endanger Chuck's life or physical health or that of his wife.  Hurt his pride yes, threaten his life no. Chuck had no legal justification to confront the pimp with a deadly weapon.  Chuck was stupid and stupidity can be fatal.

Ah, I was waiting on this one.  You see techically Dumbchuck when shot was on the otherside of his car away from the shooter and Mr. Pimp in a car not blocked in.  That's why the charges were filed.  Iminent means right now. It was also argued by the DA that the numchucks were in one hand and not at the ready.   It could just as easily gone bad for Mr. Pimp.

Shoot someone with a ballbat not at the ready not threatening you even if you suspect they will with a car separating you and an obvious escape avenue, what do you think would happen?  

Why didn't it happen in Dumb Chucks case?

Technically this was bad shoot and the DA pressed charges as a result.  A good shoot, shouldn't make it to trial period.  The fact the victim was not in a direct line with the shooter but on the opposite side of a different vehicle was very evident.  Witness testified that the nunchucks were in his left hand and was not holding them threateningly nor had even opened his mouth to say anything.

Once in court, the shooter, the accused, had all the rights and his past not subject to review while the victim wasn't on trial so his past could be dragged through the mud.  The jury aquitted based on Charlie had a reputation of being deadly and harming others so deserved what he got.  He certainly asked for it enough. I even told him he would end this way.  

Bragging and showing off got Mr. Pimp Drug Dealor off and Chuck killed even though he wasn't threatening.  His reputation was threat enough for a jury.  

Now apply this thinking to "I always carry a gun and am ready to use it."

Less than two years later Mr. Pimp  killed another man.  This time it was with a screwdirver at a VFW dance for dancing with his girl. Stabbed him in the gut.   That victim had no reputatation as a badass and no weapon.  Last I heard Mr. Pimp Drug Dealor is still in Kentucky State Pen.  I have no idea what happened to the whore.  She's way too old for the trade.  Knowing that part of the world, she had a bastard kid and now has a free three bedroom apartment, free food, free spending money, free medical, a warm spot at the bingo hall, and all on our tax dollars.
