He had a roommate who fell behind on rent and he carried him for a while.  I got the impression that the roommate is now square with the house.  If he's not, then there is a process for evicting tenants.   That process in every state involves notice and an opportunity to cure.   The courts of most states have held, in the residential leasing context, that acceptance of future rent payments and failure to give notice of default will, after some period of time, result in a waiver of allegedly past due sums.  

Rights are great things, but in court the judges think of them as "use it or lose it" propositions.  Evicting a guy for non-payment of rent that is CURRENTLY still in default and in accordance with all applicable procedures is one thing.   Telling a guy to leave because he's uncomfortable with a third-party having a key and access to his stuff, and in the case of some of you yahoos, suggesting a forcible eviction without process, is another thing entirely.

And no, I would not take the case of someone I found morally reprehensible.   But in the case of my young lawyer trial for those college hotties, they were clearly the ones with valid grievences and the judge agreed.  (BTW, so did the appeals court).

Let me tell you guys the story about the case I took a couple years out of law school for some college aged hotties.   See, they moved into a house with some guys from their dorm.   One of the guys' family owned the house and he made arbitrary and abrupt decisions thinking this "ownership" right somehow insulated him from complying with landlord tenant law.  He kicked these girls out without good cause and in violation of the landlord tenant statutes, in part (as the situation Greg describes) on the basis of "past wrongs" that the judge found had been both cured and waived under applicable law.   (The testimony at trial didn't get into this, but I was personally convinced that this guy and his buddies through their new hottie "roommates" would be fuck toys and then were frustrated when these women, you know, dated real men).  

I took this punk kid and his "family" for a wrongful eviction judgment of $5,000.00 per each of the women I represented, plus the defendants had to pay all my fees.  I then recorded the judgements against his house and the mortgage lender called the note and deed of trust under the "due on transfer" clause.   They had to sell the house to pay the judgments.  It happened that I bumped into the young punk working at 7-11 a couple months afterward.

So, you know, Greg... if you want to listen to these guys who tell you that you and your family's ownership of the house somehow gives you "super power" status with respect to your roommates, think again.   They have superior rights to your "girlfriend" and its not as open and shut as you might think.  

Be sure to post the story after you wrongfully evict these guys and they take you for a few grand, though.   Especially if one of them runs if with your headache of a girlfriend.

I'm enjoying these "drama" threads from you.

I may have mis read what he wrote, I was under the impression the guy hadnt payed his rent and broke up with his girlfriend and now didnt want his gf in the house.

He can tell them to Foff and move out and he may be able to  give her a key, if there is nothing against having someone else stay based on the lease.  However he can not forceable remove them from the property.  

I would also agree that she has screwed one or both of your roommates and that is why they no longer want her around.  She now makes them uncomfortable because they feel bad about it because they consider you a friend.

You have roommates paying rent and she's not.   People reasonably expect to be secure in their stuff.   It was wrong for the other dude to have his g/f there all the time exposed to your shit, etc., and its wrong for you to put them in the place of having to worry that this woman has access to their shit when they're not home.   Obviously they don't trust her.   Maybe she's trying to get them to bang her while you're gone.   Maybe one already has.   Maybe they are more perceptive about her M.O. than you seem to be.   Whatever.   Girlfriends with keys to places where there are roommates will always be a problem.

If you want to play house with this woman, lose the roommates and get some rent from her.

Got damn you've got a lot of drama.

Well, if your GF had screwed one of the guys and then decided whe didn't want to put out anymore that would explain quite a few things that you've posted about her recently. And it would also explain why the other roommates are now all of a sudden pissed about her being there and want her out...

My girlfriends and my roommate's girlfriends have always pretty much come and gone as they pleased. Neither of us cares. Maybe it's sorta a Hugh Hefner mentality, but I kinda like all the girls in the house.

Edited to add: Damn just read the above. Screwing roomate's girlfriend is a big no no! Looky but no touchy!!

Hopefully that's not the reason.

Install numerous net cams in your house and link them to a new ar15.com forum entitled, "Gregs World"

Scenario II.

Hire some biker dudes to come over and pretend to be moving in. Room mates boogie and the bikers will probably take GF in payment. You can then start over with a clean slate.

The house is owned by my family I am the lease holder there is no roommate lease.

That may mean fuck all depending on your state law.  Evicting someone who is there legally, or illegally can be nigh on impossible.  I cannot describe how hard it is here.  My mother spent 6 hours with the prosecuting attorney yesterday trying to find a way to evict some people in her complex that have not paid rent in 7 months.

Regardless of whether they paid rent on time (thats your call if you want to give them some slack in this area).  They didn't sign up for her to be making meals, and hanging out and sleeping there waiting for you to come home.  You being there for the MWF house play is one thing, her showing up and taking over the kitchen and living there those evenings is another.  

Sounds like its time for you and your girlfriend to either stop playing house or tell the roomates they need to find other residences and live on your own.  

I suspect you can't afford the place without roomates, or there wouldn't be an issue.  But even if you find new roomates this problem will come up again.

so you have three choices:

-Live alone and GF can come by at will

-Live with roomates and make sure GF doesn't come over without you being there.

-reduce the rent so the GF is essentially another roomate.  then she can come and go as she pleases and there is no issue.
