Lee Saturday, October 1, 2005 Alameda County's ban on possessing guns at the county fairgrounds may be unconstitutional, a federal judge has ruled in a lawsuit challenging what effectively is a ban on gun shows. Having guns at gun shows can be constitutionally protected "expressive conduct," a form of free speech under the First Amendment, U.S. District Judge Martin Jenkins said in an order Tuesday, rejecting the county's motion to dismiss a lawsuit filed by gun-show promoters Russell and Sallie Nordyke. According to county officials, the 1999 ordinance was a public-safety measure enacted one year after 16 people were hurt at a Fourth of July shooting and melee at the fairgrounds in Pleasanton. |

Oh for the love of God...
This is what you get when any word can mean anything at any time. "Freedom of expression" can apply to gunshows, but "the right of the people to keep and bear arms" applies to the militia. I think we got a bunch of people trying to be overly intellectual running around, and they've forgotten how to understand plain meaning. The Constitution may as well not exist. |

There is no RKBA or 2nd Amendment equivalent in the California constitution. The Kali supreme court already has refused to overturn the gun show ban based on 2nd Amendment grounds.
When you think about it, the 1st Amendment argument is a valid defense of gun shows. The politicians don't like the guns at gun shows. However, what they really hate is gun owners congregating at gun shows and talking about politics. We can trash Schumer, Feinstein, etal. - that's what really bothers them. Not to mention those tables filled with books about the constitution, politics and history. To a politician, knowledge is the most dangerous thing available at gun shows. |
