California Crackdown on Modified Cars
$5 million in federal money will fund a Sacramento, California effort to stop drivers in modified cars.

Police in Sacramento, California announced Wednesday that they would use $5 million in federal money to begin cracking down on auto enthusiasts who modify their vehicles. The money will be used to form an undercover "Drag-Net" unit to stop motorists who appear to be driving modified cars.

The concept, which originated in San Diego in 2001, has been spreading throughout California generating significant revenue for the state and local departments. In Santa Fe Springs, for example, twelve officers on Drag-Net duty issued 300 citations and impounded 50 vehicles in just one weekend. Several cities have drag-racing ordinances that allow police to auction off seized cars and keep the profits.

Under Drag-Net, San Diego officers come to train other departments how to look out for what they believe to be tell-tale signs of illegal modification such as window tinting, large spoilers, extra gauges or racing stickers. Police say this gives them probable cause to stop and inspect a vehicle and its engine compartment.

In practice, "excessive exaust noise" tickets are the most common violation. California law does not require police to measure sound levels objectively. Instead, according to the California Highway Patrol, the "citation is based on officer's judgment."

Drivers of stock vehicles that come from the factory with some of the characteristics of modified cars have experienced harassment under this provision. One such motorist complained on an enthusiast website that the Calfiornia Highway Patrol was using these programs to make "driving while Asian" a crime, pointing out that the department's own website has several pages dedicated to Asian involvement in street racing and "vehicle modification."

Those receiving a vehicle modification "fix-it" ticket must visit a California Bureau of Automobile Repair office and pay a $35 fee to have their car inspected. If the car fails, a judge can impose another fine of up to $2000 for failing to meet California emissions requirements.

Yes, I bet if the US border states did real inspections on legal & illegal alliens' vehicles, only about 1 in 10 would pass inspection criteria.  Oh, and while we are at it, how about confirming that these drivers actually have insurance... so when they hit my car, instead of abandoning their vehicle and running off into the weeds, I can get my car fixed on their dime.

The real sad part is that all the bolt-on bodywork made you THINK it was fast, when in reality what's under the hood is a bone-stock 4 banger, that now has to strain under all that extra weight.

Some guys really do have trick cars, and I can appreciate those.

Its alot worse under California laws since everything has to be passed through their California Air Resources Board.  Go to your local Autozone and pick out an air cleaner wingnut with a Chevy logo on it.  You'll see a little dislclaimer printed on the packaging that reads "not for sale or use in California on emission controlled vehicles", because the maker of the wingnut didn't want to put up with the bureaucratic bullshit of CARB just to sell a wingnut in Cali.  Now we all know that a wingnut doesn't alter the car's emissions at all, but since the bureaucrats didn't give their blessing to that aftermarket part, its a violation to have it on your car and can get your car impounded if the cops follow the letter of the law.

Any alteration of the emissions control equipment will make your car fail the biennial smog inspection, even if it makes the car run cleaner.  Emissions control equipment covers the engine itself, intake and exhaust systems, and everything that controls ignition timing, valve behavior, and mixture.  The idea that this covers an after-market wingnut for your air cleaner cover is just a little far-fetched, but I got hassled for not having a pre-heater hose on my '85 Nissan truck even though that has zero effect in San Diego's mild climate.

This applies only to cars registered to drive on public roads.  On private land or a racetrack, anything goes.

It was for this very reason that I continued to drive my 1968 VW Bug. No emissions testing for anything older than 1974. :)

CARB is one of the reasons I won't ever move back, either.
