Mr. Donald E. Ware, age 37, of Avon has been charged with murder.

...Marion County Prosecutor Carl Brizzi said today he would not pursue the death penalty for Ware. The facts of the case do not meet the qualifications for capital punishment in Indiana, he said.

“I am absolutely pursuing the strictest recourse possible,” Brizzi said.
The teens involved in the egg-throwing prank might face charges of criminal mischief, a misdemeanor, Brizzi said.

“They were doing something they obviously shouldn’t have been doing,” he said. “They should be held accountable in proportion to what they did.”

Though the prank didn’t justify Ware’s “vigilante justice,” Brizzi said, teens and their parents should still take the murder as a warning that pranks can escalate.

“As parents,” he said, “we all have a responsibility to let our children know there are unexpected, tragic consequences that can result from relatively benign acts.”...

Come on the kid threw and egg, the guy would have been justified in killing the kids entire family for raising such a devil.
