Deputy Kills Man Carrying Leatherman
POSTED: 5:13 p.m. PDT August 1, 2005 UPDATED: 10:42 a.m. PDT August 2, 2005 Story by nbcsandiego.com SAN DIEGO -- For the third time in five days, a San Diego Sheriff's deputy shot and killed a suspect in the North County of Vista. The shooting took place Monday at about 4 p.m. in the 800 block of Newport Drive, according to sheriff's officials. Deputies spotted a 23-year-old man they believed to be a gang member who was a suspect in a recent car theft, officials said. The suspect ran and the deputies chased him on foot. One of the deputies saw the suspect reach for what he believed was a gun, sheriff's Capt. Clay Reynard said. The deputy shot the suspect in the chest. Deputies performed CPR on the wounded suspect at the scene of the shooting. No deputies were injured in the incident. A witness described the shooting to NBC 7/39. "I don't know why he was running around there," said Felix Simental. "I don't know if the cops scared him or what, but he was just running, and they just shot him. I didn't see a weapon." The object the man was reaching for turned out to be a Leatherman-style multipurpose tool, Reynard said. The shooting is the third officer-involved shooting in Vista in the span of a week. The first shooting took place Thursday just a block away from where the suspect was shot Monday. Deputies killed a second suspect Friday night. In all three cases, the suspects were young Hispanic men. As a result of the shooting investigations, five deputies from the Vista Sheriff's substation have been taken off patrol duty. Vista sounds quaint. Banger was probably on probation and was trying to get rid of the leatherman which would be a violation of his probation. |

He was going to use the leatherman to adjust the valve on his pump-up sneakers. Seriously, "leatherman tool" now joins "knife" and "cricket bat" on the list of items not to bring to a gunfight.

Some parts of Vista do qualify as quaint. Generally those are the areas between the big bucks new development areas and the farmworker areas left over from 1920 or before. Generally from 2 houses to a block wide.

just another reason i dont go to vista if i dont have to. The cops here in Poway and north county just give 13 year olds tickets for riding scooters without helmets. Its nice to hear they are cleaning up all the gang bangers though, maybe they will start working on mira mesa soon......

There was an incident like this in Cincinatti Ohio a couple years back. An officer was chasing a teen that had warrants and saw the boy grabbing something on his pants. The officer thought the boy was reaching for a weapon so he shot and killed him. Riots came after that and now the police walk on eggshells and have to assure the public they were in the right on every shooting incident thereafter.

IIRC it was a nation wide sweep of gang members. Alot of the Mexican gangs were targeted as well as the usual ones. Funny how they have grown in size in the mid-west. |

The shooting was justified.
Firstly, the suspect made furtive movements, in and of itself a justification to use lethal force. He could be pulling a banana out of his pants, but when faced with police officers who have drawn weapons, odds are he isn't going for a snack. Secondly the Leatherman is a deadly weapon. The blades on a Leatherman WILL cut, and WILL punch through Kevlar. Even the pliars can be used effectively as a weapon to cause death or grave bodily injury. Thirdly, while looking over the sights at a known bad guy suspected of armed robbery who reaches into his pants and pulls out a metallic object with a rectangular profile visible above his hand, I have to say that I would probably pull the trigger too. The lesson here is that when the cops have drawn down on you, you need to be darn careful what you do, or they WILL shoot you. Give them a reason to think you are trying to hurt them, and they will logically assume that you are and will try to hurt you first. What continually amazes me is how f*cktards continually pull stupid crap like this. Remember the genius who aimed his cell phone at the police? What brand of STUPID did HE drink that morning? Because it seems to me that after leading police on a high speed chase, being PITed, and now being surrounded by 5 guys who are very tense and who all have Glocks pointed at you, it would be the height of friggin stupidity to go pretending your cell phone was a gun. I do not understand criminals who pull that kind of crap. I really don't. It is as if they WANT to get shot, or they have some sort of mental handicap that seems to keep them from thinking that the man with a gun over there might actually pull the trigger on that gun. |
