To restore the second amendment rights of all Americans.


IN THE HOUSE OF REPRESENTATIVES

April 19, 2005
Mr. PAUL introduced the following bill; which was referred to the Committee on the Judiciary, and in addition to the Committee on Ways and Means, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned

A BILL
To restore the second amendment rights of all Americans.


Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Second Amendment Protection Act of 2005'.

SEC. 2. REPEAL OF FEDERAL HARASSMENT PERIOD.

Public Law 103-159 is repealed, and any provisions of law amended or repealed by such Act are restored or revived as if such Act had not been enacted.

SEC. 3. REPEAL OF UNCONSTITUTIONAL DISTINCTION.

(a) Section 5845(f) of the Internal Revenue Code of 1986 is amended--

(1) by striking `which the Secretary finds is generally recognized as particularly suitable for sporting purposes'; and

(2) by striking `which the owner intends to use solely for sporting purposes'.

(b) Section 921(a)(4)(B) of title 18, United States Code, is amended by striking `which the Attorney General finds is generally recognized as particularly suitable for sporting purposes'.

(c) Section 921(a)(4) of such title is amended in the 2nd sentence by striking `which the owner intends to use solely for sporting, recreational, or cultural purposes'.

(d) Section 921(a)(17)(C) of such title is amended by striking `a projectile which the Attorney General finds is primarily intended to be used for sporting purposes,'.

(e) Section 923(j) of such title is amended by striking `devoted to the collection, competitive use, or other sporting use of firearms in the community'.

(f) Section 922(r) of such title is amended by striking `of this chapter as not being particularly suitable for or readily adaptable to sporting purposes'.

(g) Section 925(a)(3) of such title is amended by striking `determined by the Attorney General to be generally recognized as particularly suitable for sporting purposes and'.

(h) Section 925(a)(4) of such title is amended by striking `(A) determined by the Attorney General to be generally recognized as particularly suitable for sporting purposes, or determined by the Department of Defense to be a type of firearm normally classified as a war souvenir, and (B)'.

(i) Section 925(d)(3) of such title is amended by striking `and is generally recognized as particularly suitable for or readily adaptable to sporting purposes'.

(j) Section 925(e)(2) of such title is amended by striking `provided that such handguns are generally recognized as particularly suitable for or readily adaptable to sporting purposes'.

(k) Section 922 of such title is amended in each of subsections (a)(5), (a)(9), and (b)(3) by striking `lawful sporting purposes' and inserting `lawful purposes'.

SEC. 4. EFFECTIVE DATE.

The provisions of this Act shall take effect immediately upon enactment.
Here is a sample letter of what I sent.



Dear [whoever],
I am writing to you today to encourage you to support HR 1703 to help restore our second amendment rights guaranteed to us by the constitution. Clandestine individuals within the government would rather strip away individual rights the founding fathers helped to secure through bloodshed and war.

For years anti-gun forces have worked hard to strip away freedom from the people of this country. It's time that we took some of our freedom back from them. They have long argued that the 2nd amendment is not an individual right and civilians should only own sporting purpose weapons. The founding fathers themselves illustrated through testimony, convention and writ that it is right the opposite. The citizens of this country have every right to military-grade and military-style weapons for the purpose of home defense, security and homeland defense. In 1787 testimony was given to the 2nd amendment as being an individual right. The very basis of the constitutional conventions in the time period was the establishment of the bill of rights for the sole purpose of protecting individual rights and liberties. There is no reason it should be any different today. I am writing to ask you to help support and spread the word concerning HR 1703. Please help us gather support for this bill to help restore rights that should have been guaranteed and untouched.

If this bill passes it will be a crippling blow against the forces of tyranny and oppression.
Please help American Citizens regain their rights.

There is NO reason or excuse for you not to write the letter. If you're coming here to doomsay, naysay or bark about how this will never see the light of day, then go somewhere else. be sure to send snail mail too guys. reps usually dont regard e-mails as serious. send emails too if you want but snail mail and calls work best. if you're worried about long distance, don't be. there should be a local number. get to it.

My NRA-"A" rated rep Price (R-GA) did not even reply with a canned response.

At least the Bojanges twins Chambliss and Isaakson give you a good pro-gun song and dance show.

Wow, this is one hell of a way to do my first post.  I contacted my Congressman (Chris Chocola R-IN) this morning and this is the reply I got this afternoon.

Dear Steven:

Thank you for contacting me regarding the important issue of your Second Amendment rights. I appreciate hearing from you on this important issue.

As you may know, I am a strong supporter of the Second Amendment and have received an "A" rating by the NRA. I believe the Constitution is unequivocal in stating that the right to bear arms is an individual right. I will continue to defend your right to keep and bear arms, as guaranteed by the Second Amendment of the U.S. Constitution and the Indiana State Constitution, and I can assure you I will not vote for any legislation that would infringe upon that right.

You should also know that I cosponsored the Law Enforcement Officers Safety Act of 2003 (H.R. 218), which exempts current and former law enforcement officers from State laws prohibiting the carrying of concealed handguns.  H.R. 218 passed in the House on June 23, 2004, and President Bush signed it into law on July 22, 2004.  I am also a cosponsor of the Secure Access to Firearms Enhancement (SAFE) Act of 2003 (H.R. 990), which provides for reciprocity with regard to the manner in which nonresidents of a State may carry certain concealed firearms in that State.  H.R. 990 has been referred to the House Judiciary Committee.  Finally, I am a cosponsor of the Protection of Lawful Commerce in Arms Act (H.R. 1036), which would prohibit civil liability actions against manufacturers, distributors, dealers, or importers of firearms or ammunition for
damages resulting from the misuse of their products.  I voted for H.R. 1036 when it passed in the House on April 9, 2003.  It has been referred to the Senate for consideration.  As Congress continues to consider gun control legislation, I will certainly keep your thoughts in mind.

Sent to one of the Congress critters.  Got a GOOD reply:

"Dear Andrew:

Thank you for contacting me regarding H.R. 1703, the Second Amendment Protection Act of 2005. I appreciate the opportunity to respond to your concerns.

My position as an unapologetic defender of Second Amendment Rights is well-known among Congress, and I can assure you that I will do all I can to continue to uphold Second Amendment Rights.  I continually cast votes in favor of allowing law-abiding citizens the freedom to lawfully purchase and own firearms.  When our adversaries on this issue want to take away this constitutional right, they will find me on the side of the Constitution.

H.R. 1703 was introduced on March 19th by Rep. Ron Paul of Texas. This legislation aims to repeal the federal harassment period, public law 103-159, and any provisions of law amended or repealed by this act would be restored. This bill would also repeal certain distinctions within the Internal Revenue Code. This legislation was referred to both the House Judiciary Committee and the House Ways and Means Committee.

I am emailing you to voice my support for H.R. 1703: To restore the second amendment rights of all Americans.  I urge you to sign on as a co-sponsor of this legislation.

As a firearms collector, I enjoy many of the quailty long arms which are prohibited from further import by executive order.

There is alread a supply of these firearms in the country, but their limited supply makes them cost prohibitive for all but the wealthy shooter.

Hey, did anyone besides me see our Secretary of STate, Ms. Condolezza Rice on the Larry King Show last night?

SHE WAS GREAT!  King tried to corner her about "what's your position on the 2nd Amendment".  (King - love him/hate him).   You know what Conde said?   "Larry, you can't pick and choose which amendments you respect , it's ONE consititution".   King, "you support guns",  Condo, "yes Larry, it is an individual right of the people, I FULLY SUPPORT THE SECOND AMENDMENT".  

At this point I was starting to love this woman.   She continues... Conde, "Larry, I very clearly remember my dad and some other men in the neighborhood taking their guns at night to the entrance of the neighborhood to defend us during the civil right unrest"  "The Sherrif wasn't going to protect us, the people had to protect themselves"    King, "but Conde, that was then, do you still think people should have guns today?????"   Conde, "YES Larry, very much."

The above isn't exact, but it's pretty darn close.   I love that Woman - BOOOOOYA !

This is about the 5th post on this bill but it is a very worthy cause, this is the response I got from the NRA-ILA, they did respond to the e-mail I sent them within 24hrs.

Rep. Ron Paul (R, TX) introduces this legislation every congress and unfortunately it never makes it out of committee.  We are focusing our attention on the Protection of Lawful Commerce in Arms Act right now.  While HR 1703 is a good piece of legislation, we would not be doing ourselves or our members any favors by focusing attention on legislation that has no hope of moving forward at this time.  If that changes and the committee decides to move on HR 1703 we'll be on it.  We only have so many cards to play and it is important to focus on legislation where we can make the most impact.

While it pains me to read that I very much understand were he is coming from.  One winnable battle at a time.

That said, while the NRA as a lobbying body focuses on one target the Arfcom Army and like minded groups can fight for this bill.

I got the same goddamn letter, word for fucking word it seems to be a pattern response.  Write a letter save the letter and send it constantly, in short flood them.  Hammer your shitheel politicians too!!!!!!!
