not criminal.  civil, sure.  not  just for malicious prosecution.  when you get divorced, if the plaintiff gets a default (i.e., defendant doesn't answer wiithin the time allotted) attorneys fees can be taxed to the plaintiff.  attorneys fees are commonly awarded as part of the compensation given to a plaintiff.  of course, you probably won't get them if you lose.....
