In a word?
Nope! Not a farthing! Now, in some federal prosecutions, recovery of attorney's fees is permitted under certain cirsumstances! Recall that former President Clinton made a claim for recovery of his attorney's fees in defending against the Whitewater Prosecutor's investigations - which were denied! But after 25 years of practice, I've never seen the first Defendant successfully collect his attorney's fees! Eric The(BadNews)Hun

That's often quite a chunk of cash! And how about id you win a civil case? Can you go after the idiot that came after you with a 1-800-Attack dog lawyer? |

In civil cases it's very likely that you can win an award of attorney's fees IF the case was maliciously prosecuted, etc., but you'd likely wind up with a judgment against a destitute party! You might try to go after the losing party's attorney IF the court finds the case was malicious and not well-founded in law or fact. Good luck, though! Eric The(ItSeldomHappens)Hun

not criminal. civil, sure. not just for malicious prosecution. when you get divorced, if the plaintiff gets a default (i.e., defendant doesn't answer wiithin the time allotted) attorneys fees can be taxed to the plaintiff. attorneys fees are commonly awarded as part of the compensation given to a plaintiff. of course, you probably won't get them if you lose.....
