I've been surfing through our state code and came across this:

 (a) Each county is divided into militia districts according to its
 territory and population.
   
 (b) Militia districts are to remain the same as presently organized
 until changed in the manner prescribed in this chapter.

36-2-2 G
*** CODE SECTION ***  01/23/01
   
 36-2-2.
   
 Each militia district organized or changed must contain within its
 limits at least 200 persons 18 years of age or over who are
 residents at the time of the organization of the district and, in
 its formation, must not leave any older district with less than 200
 such persons.[/b]

...and this:

*** CODE SECTION ***  01/23/01
   (d) Subject to such exemptions from military duty as are created by
 the laws of the United States, [u]the unorganized militia shall consist
 of all able-bodied male residents of the state between the ages of
 17 and 45 who are not serving in any force of the organized militia
 or who are not on the state reserve list or the state retired list
 and who are, or who have declared their intention to become,
 citizens of the United States.[/u][/b]

Wow! I have lived in this state all my life and have never known this! Yeah, I've heard that WE are the militia, but never seen it written in the code!

I don't know about militia districts, but I did find this:

SECTION 1. Section 123 of the Military and Veterans Code is
amended to read:
  123.  Whenever the Governor deems it necessary, he or she may
order an enrollment to be made by officers designated by the
Governor, of all persons liable to service in the militia...[b]

it goes on to say:

[b]and he or she may thereupon order into
the service of the state any number and description of the
active militia, or [u]unorganized militia[/u][/b]

[b]255.  Every enlisted man and woman who enters the National
Guard or who is a member of the unorganized militia... [/b]

Unorganized militia. That's you!

Yeah, Rhode Island has A Military Code of Laws, originally dating prior to the Revolution, but updated continuously thereafter.  Runs to a couple of hundred pages, as I recall.  Lots of interesting and obscure laws there.  For example, a militia member going to or from an official militia function cannot be detained.  Know a lawyer who used this law to get out of a speeding ticket!

What's my point in all this? I'm sure I can find the same thing for every state! So why hasn't any lawsuits been filed against the constitutionality of these laws? What would it take to file such a law suit? Even California's Constitution starts out saying:

ARTICLE 1  DECLARATION OF RIGHTS


SECTION 1.  All people are by nature free and independent and have
inalienable rights.  Among these are enjoying and defending life and
liberty, acquiring, possessing, and protecting property, and pursuing
and obtaining safety, happiness, and privacy.[/b]

Doesn't sound like these new gun laws in California should even hold up against it's own Constitution!

I'll try to prove you wrong if I can. Have to be later on this evening though.

I did read something that stated no general issue will be made to the unorganized militia unless they were called in to the active militia status. But does this prevent the unorganized militia from obtaining their own arms? I'll research it.
