That quote is actually in many districts' opinions. That is why Emmerson in TX is so important. It says individual right and thereby creates a split among the various appeals courts. The Supreme Court often (well sometimes) agrees to hear such cases to settle the law and make it consistant throught the counrty (although, I think the S.CT already denied hearing Emmerson).

Funny how the 9th circuit court also ruled that home made machineguns that don't travel interstate are legal, the '86 cutoff notwithstanding. Too bad the defendant in that case was an ass.
