Stabbed Shopkeeper May Be Charged with Assault

By Alison Purdy, PA News

A shopkeeper who was stabbed by a shoplifter said today it was “ludicrous” that he may be prosecuted for lashing out at the thief.

Colin Moore, 32, who owns four convenience stores in Norwich, was stabbed in the back when he chased after a gang who had just robbed his shop.

Mr Moore admits he punched one of the thieves but claims it was in self-defence.

The knife wound was within two inches of his spinal cord and millimetres away from his kidneys.

He was arrested and released on bail after the youth complained to police.

“They stole £70 worth of alcohol and sandwiches. Me and my mate went after them to try to get my property back. All we wanted to do was to apprehend them until the police came but they were older and bigger than we thought they were.

“They started getting abusive and throwing bottles at us. The knife was inches away from my spine, I could have been paralysed. I also had a bottle of wine smashed over my head and needed stitches in my ear.”

Mr Moore, who runs the family business with his brother, said his shops have been repeatedly targeted by gangs of youths for the past two years.

“We have had seven armed robberies, five assaults on staff and three burglaries. Each time we report it to the police but no one has ever been caught.”

Mr Moore said when police came to the shop to arrest him he thought they had come with information about the thefts.

“I was totally shocked. I couldn’t believe it, I was so angry. It just seems ludicrous that I get stabbed and it’s me the police arrest.”

Mr Moore said he had thought about quitting the trade a number of times but refused to let the yobs beat him.

“I enjoy being a shopkeeper. You make a lot of friends and get to meet people. What else would I do. I’ve been doing it for 10 years and it’s all I’ve ever done. I’m not going to let them beat me.

Sonny Pyatt, 18, of New Catton, Norwich, is currently on remand charged with wounding with intent.

Two youths, who cannot be named for legal reasons, have appeared at Norwich Magistrates’ Court charged with theft.

A Norfolk Police spokeswoman confirmed that Mr Moore had been arrested on suspicion of causing ABH and common assault before being released on bail pending further inquiries.

What moral objection could be raised to tarring and feathering (or punishing in an irrevocable manner) a police officer who would make such an arrest?

Me and my mate went after them to try to get my property back. All we wanted to do was to apprehend them until the police came but they were older and bigger than we thought they were.

considering they ran after the suspects, it's no longer self defense because he was no longer in danger of life or limb since they were running away

Eventhough its not right that he's being charged with assault.

which is why he needs to hope the law in his area is like this so he can claim he was trying to stop a larceny instead of self defense

S 35.25 Justification; use of physical force to prevent or terminate
         larceny or criminal mischief.
A person may use physical force, other than deadly physical force,
upon another person when and to the extent that he reasonably believes
such to be necessary to prevent or terminate what he reasonably believes
to be the commission or attempted commission by such other person of
larceny or of criminal mischief with respect to property other than
premises.

"Self defense" isn't limited to responses to interpersonal violence. I doubt that even a place like the UK one has a legal duty to allow theft of property, or to allow trespass. IOW, I can't imagine that you have to stanbd by and allow people to steal from you, or that you have to allow a band of gypsies to enter your house, eat your food, and watch your TV. Force may be used to prevent or terminate a theft or trespass. In Florida (and in most places, I think) use of force less than deadly force is justified to terminate a theft. It is legal almost everywhere to chase a thief and try to get your shit back.

A theft, if violence is applied "in the course of" the taking, is robbery. Under Fla law (maybe not other states') an act occurs "in the course of a taking" if it occurs during the attempt to escape from the scene of the crime. These little fuckers are robbers under Fla law, and could have been killed with impunity.

I think the arrestee should go to the arresting officer's house, steal him blind, and stab the shit out of him if he tries to interfere.

Please defend this statement with a caselaw citation or news article. [

Where I work in California he could have shot these little turds.  And no, I don't work in the few parts of California that are still conservative.

Yes I have been to your smog infested city of L.A. (not impressed). I liked San Diego, though. Pretty testy about your state, aren't you? Don't blame you.
