Unless you can prove a current rabies shot, they will kill the dog to verify no infection regardless of what you or your neighbor think...

Some more details would help. Has the dog bitten anyone before? Why did he bite the neighbor? Was he on a leash? It may be a good idea to contact your local police department and find out about any city or state laws regarding this kind of incident. Then contact a lawyer.

When I take them out to pee I hardly ever use a leash unless there are other animals around that they might chase. As soon as I opened the door the neighbor was walking buy and the dog just went at him. This dog has never hurt anyone and I don't understand why he did it. The guy got bit right in the ass.

most area do not put down dogs on the first bite. you will want to check your local laws. try calling your vet. they might help you.

You say "I had the dog on a lease, walking him/her down the street, when this guy came running out of his house screaming at me and the dog not to shit in his yard anymore"... that freaked me out, and my dog saw this, and his/her immediate reaction was to protect her master"....
... and the dog was NOT in his yard... it was in the public street when the guy came RUNNING at me with arms flailing!!! -that'll get you off. (oh, and tell the cop that he's had a 'history' of yelling at people)... and that the whole neighborhood knows him as a problem.... |

I can't and will not do that. It was completely my fault and I should have had the dog on the leash. To be honest I am more upset that my dog did that. Right now he is locked in the bed room. I am so fucking pissed at him that I can't see straight. |

What do you think he meant when he said he would only be satisfied if the dog was put down? Is he talking legal action, or killing your dog? Has he ever had contact with this dog before? Do you know this neighbor? How bad was the bite? Again, call a lawyer ASAP

Not in NYS; the dog would be placed in quarantine. Have your licensing and shot info on the dog available; research the dog laws in your area, which you should have done long ago anyway. After the fact is a bit late to know what rules you were / are expected to follow regarding control of your animal and any possible penalties. |

Usually, The 1st and only bite is "free". The 2nd bite will cause the dog's destruction. That said, you locale may differ and the neighbor may still sue.

My brothers dog bit his next door neighbor who was there paying his kids for cutting his grass.
They kept the dog for several days to insure no rabies were present. He got the dog back but it was a pain in the ass for him. BTW it was a 175lbs Great Dane that stood over 6' when on his hind legs...... |

Say you gave the dog some non-prescribed meds (something that will affect his mental ability), and it affected his stability. You'll cease giving him the meds right away.
??? I suggest getting a lawyer and not saying anything in the first place. Do you/anyone know your neighbor at all? Maybe you could talk to him? |

Dude, as an owner, it is up to you to restrain your animals in public. this means, leash. If I got bitten in that same circumstance, I would be pissed off too... just walking down the street and I hear a door open, and some dog comes running out and bites me? dude, rightfully, this was your fault... Tell the cops that you had a leash on in your yard, and he entered your yard to yell at you. Your dog was simply responding to hostel encounter, in his/her yard.

If they called the cops, then...not knowing your relationship with yur neighbor, it does seem strained. Why would they call the cops? Do you guys not get along to begin with. If you have a prick for a neighbor, your in for a bumpy ride. If their civil folks they should be able to tell your upset about the incident and should be able to let it go. But like I just said...if they already called the cops you prolly got trouble brewin...

I am disgusted at some of the responses in this thread - suggesting accusing the neighbor of hitting the dog, making up lies about leashes and about the neighbors behavior, etc. I completely agree to NOT admit anything, and to use ANY legal avenue to keep your dog safe (and to get a lawyer if necessary), but some of this bullshit is depressing. Are there really SO MANY people on ar15.com that have no concept of PERSONAL RESPONSIBILITY and ACCOUNTABILITY?
The fact is that his dog attacked and bit a neighbor (seemingly completely unprovoked). Hopefully it'll not escalate to lawyers, etc - and you'll just be required to keep him leashed in the future (and will probably get a warning the a second bite will result in him being taken away). I'm guessing and HOPING that the first bite is not something that can result in the dog being taken away - especially if you can document vaccinations. Fingers crossed that everything will work out well !!! |

If it were me, I'd put my dog down post haste, and offer to pay for the medical attention.
I swore to my dog when she was a pup that one snarl or nip at the kids, or an angry bite at someone that didn't deserve it, and she would get deep sixed, with a bullet. She isn't stupid. Her life is far too good to mess it up like that. |

See if your Homeowners Insurance covers injuries from Dog Bites.
I doubt the Fuzz will put the dog down if this is a first time and it wasn't severe. However the neighbor will do all he can to play it up, if your Homeowners insurance covers dog bites, it will save you lots of $$$ in BS medical expenses for the neighbor. ETA:
