Ok, I have a 1976 K5 Blazer parked in my driveway. My covenance is harassing me because the vehicle is not registered. To them it is a junk vehicle and must be removed from the property or screened from view.

My question is, The vehicle does run, but I do not drive it on the street. It is trailered from trail to home and such. If the vehicle in question is not used on the street, can they come and take it out of my driveway?

This would be stealing would it not? If I were to find some dude hooking up to it and confronted them, possible using force to protect my property could I get in trouble?

I just can't see how a home owners association can TAKE a vehicle out of someone’s driveway!

What the hell should I do here?

I assume this is similar to a homeowner's association?

I don't know why in the blue fuck people live in those nazi enclaves!  You would think that the Del Boca Vista incident taught people a lesson.

But noooooooooooo...

Damned if I let anyone tell me what I'll do to my house.  Or in my yard.  If I want a 78 Gremlin parked in my yard on cinder blocks, then that's what I'll have.

Fuck getting it registered. That's a requirement for using the vehicle on HIGHWAYS, not something a PRIVATE GROUP like the NAZI Homeowners ASS. can force you to do.

As long as the vehicle is legal by the laws of your state, I'd tell them to kiss my hairy ass.

So take a photo of one of your other plates, blow it up to size, and stick it on the back of truck.   If you don't drive it on the street, it shouldn't matter.  Keep the truck clean, too...

I dont think a private homeowners Assc can seize property legally, I mean who do they think they are the Govt.  I would tell them to go fuck themselves and you will take physicall action if they try and steal your property or call the cops when you see them doing it.

The HA can't seize the vehicle, they are sneakier than that anyway - they will put a lien on your home to queer the deal when you try to sell.

This is why I don't want to live where there is an HOA. Actually, I'd like to move in, see an HOA form, and, since I'm not bound by their covenant, being grandfathered, paint my house plaid and watch them ineffectually screech.

I know FL has a law about having cars on your property that arent registered.  They have to be covered up or not seen from the road.  But if you live outside city limits it doesnt affect you.  YMMV

I think you'll find all the answers to your questions in the copy of the covenent you signed when you bought your home.  You are also probably going to find that they can and will do it and it will stand up in court.  Not only that, but they'll charge you storage fees and if you don't pay them they'll slap a lien on your house so that you have to pay it before you sell.  

Best get a copy and read before you take anyone's advice.

This is what is so funny about it... We live in a damn $106,000 home located next to the damn train tracks. My neighbor has a full 18 wheeler parked along side his house. Several folks have stock cars painted crazy ass colors and beat to shit parked on the street.

Nobody in my damn neighborhood gives a rats ass about what things look like, but we have this stupid Nazi HOA that has hired a company to do the dirty work.

My neighbor with the 18 Wheeler said "Come get the sum' bitch! If you find a wrecker that can take my rig. I will let ya have it! HAHA ha *Wheeeeezzzee*  Ha!"

I just can't justify spending the money on a rig I don't drive on the street just so some jack ass can drive by and say"Yep he has a lil sticker! Good to go!"

We live in Idaho if that helps.

Oh. And yes I have a 68 Charger with an Indy head 440 that I have broken cams in on numerous occasions and the neighbors LOVE the open headers!!

People came over to watch and were yelling Sounds good man!!

Park it backwards in the driveway so they cant see the registration from the street. We lived in a HOA neighborhood when I was growing up and my dad got so sick of it he actually fertilized the weeds in the grass just to piss them off. If you want to get rid of the K5 I've got an '86 here to keep it company

I once knew a guy who had teh same problem... managed to get his excess vehicles registered in Mexico.... it was a valid registration and cost him very little.

Hell, buy some Mexican plates somewhere and print up a fake mexican registraion on your computer that matches the plates and your VIN.... how the hell would they ever verify if its legit or not?

I bet you can get a Mexican or other odball plate on ebay cheap.

Check your city's definition of "junk vehicle."  Yours may well fit the definition.  If that's the case, they can use city code against you.  Putting it behind a privacy fence or away from "normal view" could fix the problem.

Also, you probably signed a document agreeing to their stupid rules.  In cases like this, it's always best to comply with both the city and the HOA in the most obnoxious and gaudy way possible.  Perhaps a hot pink tarp?  Or maybe run an extension cord and put a strobe light inside it all night every night.  Not shining into the street, just put it on the floor and make an attention-grabbing distraction.  Just be in compliance when you do something obnoxious.

Your first mistake was moving into a place where you gave them the authority to tell you what to do.

Now you have 2 choices

1 screen the car
2 register the car

The other term for these places is "pablum city" (for people who love all the rules as long as it doesn't apply to them) or naziville (for people who love power trips.)

Well I am not storing it and its operable, and It does ot have to be registered so long as it does not get driven on a highway.

Double check city code, but it sounds like you may be clear.  Sometimes a nicely typed and professionally-worded "fuck you" letter does the trick.  I did one for my mom that silenced her tormentors once and for all.  State the facts, demonstrate that you are in compliance and politely tell them to kiss your ass.

If it can not legally drive on the road then it is inoperable buy there definition.  Which means you ARE storing it since I doubt you are only driving it on your property.

Having lived in a townhouse community where we had a HOA, I see both sides.  Personally I give a shit what my place looks like, and if I choose to sell it I prefer not to have some two-tooth redneck dipshit with a monster truck in the driveway fuck up my property values.  I chose to join the HOA (if you can't beat 'em join 'em?) to ensure that I had a voice in the decisions that were being made.  It was definately time well spent.

It sounds, however, like in general your neighborhood is full of two-tooth rednecks, none of whom seem to give a crap what their houses look like.  In that case I would find out from the neighbors if all of their eyesore junk vehicles are being targeted as well.

Oh, and PS, when I was on the board if your idiot neighbor had told me "come and get it" after parking a rig, in violation of the HOA rules, in his driveway, you can bet your sweet ass I'd find a way to have it dragged out of there.

I will never understand why people bitch about HOA rules.  If you don't want to deal with it, buy yourself a mobile home in a mobile home park and enjoy your two-tooth lifestyle with the rest of the bumpkins.

Hey, here’s a thought; get involved!

That’s right; you too can take a hand in your own destiny.

Find out which members of your community are on the community board of directors.  Talk to them.  Explain the situation.  Ask them to call off the outsourced enforcement company.  Perhaps ask them to rewrite the rules so your operable, unregistered truck is not in violation.  

Sounds like a lot of neighbors think like you do, therefore you should have no problem getting elected to the board and taking care of it yourself if the current board is unresponsive.  

Or you could just play cat and mouse with the outsourced enforcement company.  

SO what’s it going to be?  Get involved and “own” the enforcement company or dick around until you get your trail rig towed?

Except that people voluntarily join these things!  We did screenings of every homeowner when they bought, and every homeowner got a copy of the rules.  I can't tell you how many times some dipshit, after being told verbally and in writing PRIOR TO BUYING, that they weren't allowed to have a sattelite showing would run one up a pole within a week of moving in.  And then bitch about the fines!


It's one thing to band together to finance and maintain common property such as a condo complex and a totally another to start making lifestyle decisions.  Open ended associations with the ability to change the rules is a blight on our society and totally contrary to the American way of life.


I have never run into an "open eneded association", and I'm not really sure what you mean by it.  In order for our rules to be amended we had to have (IIRC) 2/3s majority of a quorum of the homeowners, not just the board, approve it.  The only change that had ever been made in 15 years was the banning of renters.

I have absolutely no interest in "fair".  I despise that word.  It's entirely too subjective.  Let's stick to facts.

Fact 1: Anyone who bought a place in my old community went through a "screening" which really was more of a synopsis of the most often violated rules (like the dish thing, don't put your trash out in bags, don't be late with your dues, don't take bottles into the pool, etc.).

Fact 2: Anyone who bought a place in my old community was given a copy of the current set of rules, which clearly outline the process for changing those rules.  If you don't like the rules, or the way they can be ammended, don't buy a place there.  Nobody if forcing you to.

I was on the screening committee.  Prior to me getting on that committee they had never turned anyone down.  I turned down several, mostly due to their credit and their debt/income ratio.  In fact, I never actually turned anyone down.  I just said that their info wasn't sufficient, and that they needed to provide more to prove that they could afford their 4 kids, a $1.3k mortgage payment, a $300/month car payment, and $500/month in credit card debt.  Oh, and the $130/month dues, all on a $25k/year salary.  They either went away, or provided proof of an outside income (like alimony/child support etc.)

You keep equating all of this to communism/socialism.  Sorry, that "doesn't cut it".  Nobody forces anybody to buy in a community with a HOA.  It's a choice.  I just don't get why people do, and then bitch that they aren't allowed to park a lime green motorhome with no registration and an 8' dish antenna on the roof right out in the street.

No, they have to be the majority of the community's dream.  You still don't get it.  People VOLUNTARILY BUY INTO THESE COUMMINITIES.  Sorry, I have no sympathy for people that rush into buying something as critical as a home without paying attention to the potential for unhappiness.

Now, if out of nowhere, in a neighborhood where you'd been living for 10 years, a HOA somehow formed, and was actually granted power to make decisions, and enforce rules you had no say in, I would support the right of the individual homeowner.  But, since that doesn't happen.....

Just in case....

There are several OC/CS systems that are designed to protect a stationary object.  Rig the vehicle with one of these.  If they come to move it, they will get a legal, unpleasant, non-lethal surprise.

IIRC you were allowed to have a dish, just not "in plain view".  Since all of the townhomes had 6' tall privacy fence, there was no reason the dish had to be exposed to function.  Some people did install them above the top of the fenceline, but then concealed them with plants (like on a balcony for example).  I never heard one person complain that the dish out of site wouldn't work.

Depending on your local zoning laws they may have you.  If there is something in the zoning like there is here about not having any unregistered vehicles on your property unless you're a licensed auto salvage yard, the local (county or otherwise) government can have you remove it.  If its in a garage they can't say too much.
