Hearing Set For Soldier Accused Of Trying To Aid Terrorists

SEATTLE -- A 26-year-old Washington National Guard member faces a military hearing on charges that he tried to give information to al-Qaida.

Spc. Ryan G. Anderson, a member of the Guard's 81st Armor Brigade, was arrested in February and charged with four counts of attempting to provide the terrorist network with information about U.S. troop strength and tactics, as well as methods for killing Army personnel.

His hearing was scheduled for Wednesday.

Under the Uniform Code of Military Justice, those convicted of trying to aid the enemy could face the death penalty.

Anderson was arrested after Army investigators alleged he gave information to undercover U.S. agents, apparently believing they were part of al-Qaida.

Anderson, who once wrote, "Let's overthrow the government!" in a high school friend's yearbook, has spent the last three months jailed at the Regional Corrections Facility at this Army base south of Tacoma where his brigade was based.

The hearing is an Article 32 proceeding, similar to a preliminary hearing in civilian court, where military prosecutors will present evidence to determine whether Anderson will face a court-martial.

The hearing gives Anderson and his lawyers the chance to hear about the evidence against him and to ask if they can question material witnesses at trial.

"What you're trying to do is find out what the government's case is," said David Sheldon, a Washington, D.C., attorney who specializes in military law.

Army spokesman Joe Hitt said military prosecutors were not commenting on the case. Several calls requesting comment from Anderson's defense attorneys were not returned.

Anderson grew up in Everett, where classmates at Cascade High School described him as a paramilitary enthusiast who was passionate about guns. After high school, he wrote a number of letters to the editor of The Herald newspaper.

Army Breaks Its Silence On Charges

One published in January 1999 said, "Should any law be passed which allows anyone to come and, without due cause, take my arms, I and every other lawfully armed American citizen has a right to resist that degradation with every means possible."

Raised in the Lutheran church, Anderson began studying Islam while attending Washington State University and eventually converted.

In another letter published in The Herald in November 2002, he wrote: "In my three years as an observant Muslim, I've encountered nothing but kindness, patience, courtesy and understanding from them. On the other hand, I have experienced bigotry, hatred and mindless rage from so-called 'educated thinkers' here in the U.S."

He graduated from WSU with a history degree in 2002 and joined the National Guard. He is a tank crew member with the 81st Brigade, which is now deployed in Iraq.

The Army, the FBI and the Department of Justice conducted a joint sting operation and arrested Anderson Feb. 12 at the Lynnwood apartment where he lived with his wife.

Investigators have not said how or why they became interested in Anderson's activities, but defense officials speaking on condition of anonymity said he had signed on to extremist Internet chat rooms and tried contacting al-Qaida operatives.

The charges against Anderson allege he disclosed "true information" to undercover agents about U.S. Army troop strength, movements, equipment, tactics and weapons systems, as well as methods of killing Army personnel and destroying Army weapons systems and equipment.

The Army also alleges he tried to aid the enemy by passing sketches of the M1A1 and M1A2 tanks, as well as a computer disc that included his passport photo, weapons card and military ID card.

Soldiers with Anderson's job typically operate the M1A1 Abrams, the Army's main battle tank.

Sheldon once represented a Marine corporal who was charged in a case similar to Anderson's. Charles Anzalone, a telephone lineman stationed in Yuma, Ariz., was convicted of attempted espionage in 1991 after trying to share information with the Soviet Embassy.

He got 15 years in prison at first -- a sentence was later reduced to eight years, Sheldon said.

"That was not during a time of war," Sheldon said. "Because of the operations in Afghanistan and because al-Qaida is a confirmed enemy of the United States, if someone did attempt to pass on information ... that would be tantamount to treasonous behavior, which would warrant the death penalty."

I fail to see how what this man "attempted" to do compares in the least with the aid and comfort that the liberal media has provided to "the terrorist network" by under cutting popular support for our troops, demoralizing out troops, and stimulating "the terrorist network" resolve and strength.

While his comments here lead me to suspect that he is guilty, let us not forget that the army has a track pattern of charging muslims within its ranks with crimes of this sort, and then just before trial they drop the charges to something stupid like looking at porn in a no porn area.

Let's wait and see the complete case before we call for a death penalty.

I had a buddy that was an Army JAG. My impression was that if they had questions as to whether you were guilty they would resolve it somehow before the "indictment" (I think that's the Article 19 or whatever he is facing today and tomorrow) and the trial. I got the impression that the trials were, well not a foregone conclusion but that they didn't go the defendant's way too often

IIRC, he has the right to mixed jury of Officers and Enlisted (Usually NCO's) but most defendants opt for a all Officer jury as they tend to be more (Much More) leniant than the NCO's!

Initially, Anderson was charged with four counts of trying to communicate with terrorists. The Army added a fifth charge last month, which was not disclosed to the media until Wednesday. It alleges that at one point, Anderson told undercover military personnel: "I wish to desert from the U.S. Army. I wish to defect from the United States. I wish to join al-Qaida, train its members and conduct terrorist attacks."

That's the thing isn't it, if he really was trying to pass on information to AQ or other nasty little critters who are likely to use it on our soldier then it's time to fry.

But does passing on information about mobility kills on M1's or just discussing weak spots while shooting the shit on a board like this count as aiding and abetting the enemy. I'd like to see the evidence, and know specifically what they had him for before passing judgment.

Although they probably consider us 'extremists', I think in this case they are referring to Islamic websites.
