Although TX has the lethal injection, there was a motion to modify the method of execution recently. Some claim the "cocktail" caused such excruciating pain in the individual, that it was inhumane.

The judge dismissed it.

Malvo would deserve that cocktail. Does VA have the electric chair?

Virginia is supposed to have the fewest succesful Death Penalty appeals, and the least time from sentencing to carrying out of sentence.

Actually I don't know why I am so worried. If Virginia is like AZ, we have seen a 50% INCREASE in the number of death sentances handed down since the Supreme Court said that juries had to decide both guilt AND punishment.

Exactly the opposite of what the trial lawyers association thought would happen!

Though the Judges weren't suprised, thats why they lobbied against changing the rules. Apparently they were more in tune with the behavior of juries than the lawyers were! We have also seen a increase of about 25% of death penalties being set aside or sent back for juries to reconsider by the appeals court in order to correct overzealous or vindictive juries.
