Just got the order.

Upon the vote of a majority of nonrecused active judges, it is ordered that
this case be reheard en banc pursuant to Federal Rule of Appellate Procedure 35(a)
and Circuit Rule 35-3. The three judge panel disposition in this case shall not be
cited as precedent by or to any court of the Ninth Circuit.

Looks like we go en banc now.

Roberts is against total bans, (not scary rifles but FUDD guns) probably a bolt action, shotgun, handgun’s are okay type of guy.

That’s why SCOTUS punts these cases, they don’t have the perfect case that even Roberts would agree with.

It is an opinion but in my opinion is likely the correct opinion at least as far as Robert goes.

Not sure I would guarantee they'll take the case when/if we have another pick but I do think pretty likely chance Roberts would screw us.

On Thursday, the Supreme Court stayed a lower court decision that openly defied its most recent case protecting the right to an abortion. Thursday’s order was unexpected, given the ideological makeup of the Supreme Court, and it is likely to be very temporary.

The decision was 5-4, with Chief Justice John Roberts crossing over to vote with the court’s liberal bloc. The stay will last only until the court has an opportunity to consider a request to give the case a full hearing — a request it will most likely grant. That means that the Supreme Court could overrule or drastically undercut the right to an abortion as soon as 2020.

All appeals from the Circuit Courts go up to SCOTUS. A split improves the odds that it will be heard but it isn't a guarantee.
