While I agree that this painting falls under "free speech", not being able to put a picture of a decapitated Obama next to it would fall under "restricted free speech". Just because you can't do one doesn't mean the other isn't totally constitutionally protected.
And by the way, an Obama picture would be protected constitutionally, it wouldn't, however, last long under the misguided ideals of the same individual that put up the Trump and Captain America picture. People want free speech as long as it's theirs. |
