Human rights outcry as boy, 4, accused of rape

Mexican City authorities initiated a rape investigation against a four-year-old boy after he was accused of sexually molesting a young girl, according to a government human rights group that today denounced the treatment of the accused child.

The boy, accompanied by his father, appeared before a magistrate who read the boy his rights and the accusations against him - and warned him to be truthful - according to the Mexico City Human Rights Commission.

"This commission believes that a minor unnecessarily was treated as an adult," said commission president Emilio Alvarez, who noted that police searched for the child at his kindergarten.

Alvarez said the mother of a girl, also four, accused the boy of sexual assault in December, but that authorities initiated an investigation for rape.

At a press conference today, Mexico City Attorney General Bernardo Batiz acknowledged that an investigation was launched against the boy, but said it was halted in January and that a public employee had been disciplined.


An apology was made to the family of the boy earlier in the year, according to the city attorney general's office.

An ombudsman for the city government, Alvarez emphasised that the investigation violated Mexican law because "you are dealing with a boy of four, who not only can't be charged but also is not a person responsible for his actions."

The commission has recommended that the federal justice department investigate the behaviour of the public employees who initiated the investigation.
