I cannot see the photo.
However, if it has a rifled .60" bore, utilizing a cartridge, it is already illegal in the United States as anything but a Destructive Device. |

The BATF can classify firearms that would otherwise be restricted as DDs as having primarily a sporting use, making them title 1 firearms. Most shotguns would be DDs if it were not for this. I believe they've classified guns chambered in .600 Nitro, .700 Nitro and some other calibers designed for big-game as 'sporting' guns, so they're not DDs. BTW, I don't think rifling has anything to do with whether it can be classified as a DD or not. Someone please correct me if I'm totally off base. |

I see this thrown around quite a bit, however if thats the case why can I go to my local gun store and buy .577 Nitro? Neither the rifle nor the ammo are restricted, so how can that be true? |

Shotguns and slugguns are exempt. I believe muzzle-loaders / black-powder items are also exempt.
All other rifles (or pistols) which utilize a cartridge that has a bore size larger than .50" is considered a Destructive Device. If you want me to drag out the actual wording from BATF, I will, but it says the same thing. You show me a new rifle (other than a slug gun) that you can buy "off the shelf" in America that has a bore size of over .50" and you're showing me a Destructive Device, unless it is an antique. There are also provisions for having a big-bore rifle "reclassed" as a sporting rifle, but its a pain in the ass, so not very common. |

BATF makes certain exemptions for cartridges over .50 that are "sporting", and not restricted. All of the big Nitro's, and many, many others are perfectly legal, and can be freely transferred as regular long guns; not class 3. A few are... .50 BMG .500 A-Square .500 Jeffery .50-140 Sharps .50-140 Winchester Express .505 Gibbs .577 Nitro Express 3 Inch .577 Snider .577 Tyrannosaur .585 Nyati .600 Nitro Express .700 Nitro Express The smooth bore thing has to do with Lloyd Bensten citing Street Sweepers and USAS-12's as not being "sporting", thus used their bore diamater as being justification. |
