Last Wednesday, Alabama Senate Bill 377 cleared
the state’s Senate Judiciary Committee. The bill, sponsored by
State Senator Greg Albritton (R-Range), would eliminate a requirement
that marrying couples obtain a license from a probate judge in order to
marry, replacing it instead with a marriage contract that, according to Decatur Daily,
would require a signature from a notary public, clergy member, or
attorney. The legislation is now eligible for a full vote by the Alabama
Senate.

"The sanctity of marriage cannot be sanctified by government of
men. That is where we have gotten ourselves in trouble,” said Senator
Albritton to AL.com. "The purpose of Senate Bill 377 is to bring order out of chaos.”

Oh now they're worried about the government sanctifying marriage. Curious that clergy is still listed as a solemnizing agent. - TS

It's about time. The government needs to stay the hell out of marriage (and a hell of a lot of other things).

Bardwell, who's held his post more than 30 years, said he refused to
perform the ceremony because of his concern for the future of the
couple's children.

Bardwell told "Early Show" co-anchor Harry Smith, "I've
had countless numbers of people that was born in that situation, and
that they claim that the blacks or the whites didn't accept the
children. And I didn't want to put the children in that position."

Some places don't licenses dogs either.

But I bet if the parties don't sign a valid marriage contract when divorce or separation comes around only the lawyers will get rich.

Smart move.  Let it be like old times.  Marriage started in the church.

Now, if they'll make divorces the same way, things will be better for everyone.

I was joking about this very thing with my wife 3-4 years ago.

Get a 'civil' divorce, but stay married as far as church and God is concerned.

Uncontested, no alimony or nothing.

She applies for Sec 8 money, rents the house from me (but I be staying there, yo, wit da baby momma) , get SNAP, other bennies for the kids, scholarships for the kids, etc etc etc.

Nothing changes in our lives but a piece of paper and $250 fee for lawyer and we would reap 40K or so of .gov bennies.

Just wait, when the avg church going tax payer that gets raped by the IRS and lives in a state where marriage is no longer a .gov thing understands the implications of married in the church and single in the eyes of the .gov,  the cost of the welfare state is gonna skyrocket.

Fairly simple to prove common law marriage in this state if there is one.

They are in this state.  You agree to what you want.  Can't agree?  Judge decides.
