People are weird.

ETA:  Why not just have the HOA own everything, and residents can pay a fixed monthly amount to go towards the servicing of mortgages, maintenance, taxes, etc?  They could call that amount "rent," I'd think it would really streamline the whole deal.

Orlandos' lawyers said in court papers that the Orlandos' pickup is a "private, passenger-type, pleasure automobile" and therefore is in compliance with the rules. Orlando and his lawyer, Tom Cerio, said the pickup is registered with the state as a "passenger vehicle" and not as a commercial vehicle. And the Orlandos do not have commercial drivers' licenses.

That would suck in Florida... My Avalanche weighed so much it automatically was classified as a commercial vehicle here even though it was our personal vehicle.

You want to sign a one sided document and then expect them not to be able to change or interpret.... well then by all means go ahead.

PS. I read the article.  I followed the links and read the bylaws and rules.  How far did you get?

I once lived in an HOA community.
I had a couple run-ins with them, however in my case, they were right: I wasn't abiding by the contract.
That being said, I would never do it again. The assholes in charge are..................assholes. And the quote above is exactly right. Most of them are on a power trip. And some of them use their position to try to make every one conform to what THEY want and not nessesarily what is in the contract.

In the city I lived in at the time, almost any house you would actually want to buy, there was an HOA. Only the older, more run down neighborhoods didn't have HOAs. There really wasn't much option other than to leave the city. Within about two or three years I left the city and commuted 70 miles.

This.  I also own properties under an HOA.

I'll also add its just not that hard to win an election and get yourself on an HOA board and straighten their shit out.  Especially if there is a tyrant that everyone hates.  My wife has done it twice.

I like my HOA in our rural subdivision. We can't have the vehicle up on blocks in the front yard, although the side yard seems to be OK. We can't have pigs. Every other animal is good to go. There's cows, horses. sheep, goats, chickens, ducks, geese, and who knows what else. I've even seen one Emu. Any permanent dwelling has to be at least 600 sf and can't be made from used building materials. After a little incident where a mobile home was so rotted out that it fell apart being moved here (luckily on the county road right before it got here, so it was the counties problem), all used mobile homes have to be looked at before them can be moved in.

The rules are harsh, but we manage.

I just bought a couple of acres on a dead-end street with no HOA.

My property value will probably not go up, due to the mobile homes, Cadillac skeletons, abandoned appliances and kid's toys, general disrepair, and shrubbery that surrounds my modestly maintained yard/home.

You know what?  That's not why I moved there.

Yep.  The HOA's assertion that his personal pickup by definition is not a "passenger vehicle" is idiotic.  Also, just going by that one picture IMO those homes don't look nearly fancy enough to worry about even commercial vehicles in driveways much less personal pickup trucks.

Depends on what you want in a home.

If your lifestyle fits a particular mold that is consistent with HOA rules, it's a nice deal to avoid neighbors doing things that can kill your property value.

If you are the kind of guy who wants more freedom to do whatever the hell you want, then it's probably not a good fit.

Simple solution.  HOA changes the covenants.

Reading the HOA agreement, homeowners/renters, agree that if there is a 56 homeowners to vote YES on adding trucks to the list of vehicles then they are legally able to change the very definition.  Apparently they have had dozens of complaints on the guys truck in the driveway judging by their meeting minutes... so getting 56 is probably not going to be a stretch.

Apparently the issue isn't as much as with trucks as it's with heavy vehicles because they have light asphalt driveways.   Driveways are also not homeowner property, HOA owns it all.

Appears that other home owners complied to have their trucks removed from the driveways.

Looking at their other meeting minutes and how they fine residents for accidentally driving off the driveway, having satellite dishes, etc , I go full circle back to my first comment "his problem, he signed the damn HOA agreements".  Why you would buy a property and not own any of it's exterior is beyond me.
