Actually the Opinion by the 9th only refers to Bellisiles book in regards to the definition of a machine gun (what a machine gun is ). The court doesn't base its opinion on Belisiles work.

Reading the foot notes is pretty interesting.

I must say...that while the 9th circuit court of appeals does make a good case, I disagree with it and think that their arguement for a collective right is based upon a rather torturous deconstruction of the semantics of the second amendment.
