Do you actually propose that trial lawyers be free to impose [u]billion[/u]-dollar penalties against [u]individuals[/u] and [u]trillion[/u]-dollar penalties against [u]companies[/u]? That's the logical conclusion of your position.

Do you actually believe that when a trial liar (Oops! I meant lawyer!) charges his client 40% of the take, that he actually has the interests of his [u]client[/u] in mind? Can you say [u]conflict of interest[/u]?

Even now, doctors are leaving the practice in droves because they cannot afford to pay the liability insurance required to protect themselves from the sharks you are defending. What about the folks who rely on [u]them[/u] for medical care? Don't you care about [u]them[/u]? Of course not! [u]You're[/u] rich. You can afford to get top-notch care and pay for it out-of-pocket. Who's side are [u]YOU[/u] on, Ms. Thomas?

Tell you what. You want unlimited penalties? Fine. But in return, [u]I challenge you to support a law that prohibits a lawyer from charging a client a percentage of the take[/u]. If he wants to charge $50,000 per hour, that's up to him and his client. If he wins the case, the client owes him for his time, [u]and that's it[/u]. If he loses, he must waive his fees (after all, he failed to provide the service he promised). Are you big enough to defend that? It sounds fair to me! The scum-sucking lawyer is still able to make a killing off the pain of others without contributing anything worthwhile to society, and the poor victim you pretend to care so much about can still be money-blinded when a loved-one dies! It's perfect!

Oh, I know you won't support it, though. It's not as though logic has any place in the brain of a Liberal...

I am completely for consumer protection, however, this is the job of the government agencies you listed in your article of 2 Jan, 2003 titled "Whose side are you on, Mr. President?" not trial lawyers like yourself.
You have the audacity to view yourself as a proverbial "Knight In Shining Armor" coming to the aid of the defenseless consumer.  Get over yourself.  You are in the business of making a buck like the rest of us capitalists, looking out for your own interests above all others.  If there is a cap on damage awards, which
there should be, you stand to lose.  No more
million-dollar lawsuits involving hot coffee.  There will be no more lawsuits making individuals independently wealthy.  Plain and simple, you will lose money in this deal and you can not stand to see that.  
    Recently, there was a news report dealing with the "crisis in healthcare" about doctors leaving their practices because they cant afford the premiums on malpractice insurance.  These premiums are your doing.  True, there are "doctors" out there who are absolutely at fault when they make a mistake.  However, there are some, who lose their shirts in litigation because they  mis-diagnosed a condition - a
diagnosis that any other doctor would have made if put in the same position.  If we lose all the doctors in my state, what am I to do?  Your pockets will be full but I will be dead because there are no trauma surgeons left to operate on me if I sustain a horrible traffic accident going to work.  Let me ask you, just whom do YOU feel compassion for Ms. Thomas?
