You can only obtain an Order of Protection (other than against a family member or someone you have a child with etc) if there are criminal charges filed against the other person. Until he commits a crime there ain't much you can do.

Pepper spray is legal and sold over the counter in NY. Having an illegal pistol in NY is a Felony and usually ends up in spending some time in jail and although I carry a pistol, they are useful in limited circumstances. On the other hand I am a member of the Upstate Winter Softball League and you never know when there will be a game!

Of course if I was really scared I'd probably decide that was the week to volunteer as Ed Sr.'s executive assistant.

Hate to say it but forget the court. They won't do a damn thing but make you feel impotent.

Some nut saw my wife drop off my kid at school and started stalking her.  He would call then hangup, follow her, roam around my house (well till I scared him off one night and I won't repeat how).  Hell, we didn't even know this guys name.  After canvasing the school parents, we ran across other mothers who he had done the same thing.  I finally got his name. My first instinct was as you would guess but my wife insisted we take him to court.  Best advice I got was from the Sheriffs office which told me I should kick his ass which was my first instinct but I listened to my wife and court we went.

Now keep in mind, my wife is ultra conservative Christian and at the time secretary of the PTA. We are talking citzen plus here.  We walk into court and can't say shit as this dipshit not only doesn't deny a thing but insists his rights will be violated by a restraining order.  Now the thing gets ugly as my wife is questioned like she was responsible.  The judge just couldn't fathom that this nut case would stalk a woman that hadn't even spoken to him.  He had all the rights and all the say while we just sat there. I'm getting really pissed as I sat there listening to this shit knowing this guy had done this repeatily to other women.

During the break, we were all put together in the hallway.  The stalker tried to study his notes while I three inches from his face without blinking stared hatred at him the whole time thinking what I would do in a different setting.  The guy started to sweat like a pig and shake like a leaf.  Back in court, once again we can't say shit but now the nut case wants a restraining order on me.  I imediately ask for a postponement, walk to the back of the court, pick the best criminal lawer in the county, and hand him $200. A prompt postponement followed. After that not a damn thing happened.

To sum the story up, my familly was terrorized for four weeks by this freak of nature that only God knows was on his mind got his jollies. My wife was treated like a criminal in court while this non-tax paying freak of nature got to play lawyer.  Ultimately, the issue was resolved my way which was alot worse than just a stareing down. Let's just say the freak won't even come into our county now let alone near me or mine.  The sad part is I'm sure he is still out there doing the same to someone elses family.

Ultimately feeling threatened even stalked gets you nothing from the court.  The cops hate this as much as you do. By court standards, your police are there to arrest criminals not stop crime from happening. It is up to you to protect you and yours in this case.  Think of it as a war and use basic stratagems and tactics.

You pick the high ground for battle not the enemy.  Public places give the advantage to the bad guy for it will limit your options.

Secure your home.  Motion lights are cheap and a loaded gun in every room saves time in an emergency.  

The best defense is a good offense.  Confront him on your terms and draw the thing to a conclusion or you will be wondering for a long time when he will do the same to you. This step may intimidate the guy and make the other steps unnecessary. Call him up.

If worse comes to worse remember this. "I feared for my life see the deadly weapon he had. I want a lawyer."
