I recently fell out of a van at an Embassy Suites...it was their shuttle, and I was not under the influence of anything.



The resulting injury has left me unable to walk for the last 6 days amd in a high level of pain.




I am not the suing type, and pretty much jusy walked it off and went to my room.  I have missed no time for work, amd am out a $20 copay.




I think I did right dealing with, what I think was my own mis-step...yet my sister in law insists I should make the hotel pay and I should sue them and get money.




I'm bored off my ass, and am ready to go out...but can't.




What say the gang in GD?  Should I have made the hotel pick up the expensese?

I fail to see any negligence listed in your post.






Were you asked to exit onto ice? Were the vehicle steps wet? Did an employee pull you out the door?







They aren't responsible just because you forgot how to step out of a vehicle.

The van has a low door opening...when I ducked my head to get out, I stepped amend missed the step...and the heel of my boot caught it...jamming my toes down, and impacting the ground...so my foot bent forward and clockwise.

 



The hotel staff was terrified...I just asked for some ice and Tylenol...told them I fell on my own.  




My SIL is here amd she went off telling me I should sue Embassy Suites.




I just don't see it that way.  She's always looking for so,ething for nothing.




I got x rays on Monday...no bone damage...just a severe sprain.  Like I said...I'm out nothing more than my $20 copay.  I don't feel like I suffered loss...heck..I've got a big bottle of happy pills out of it.

About 10 years ago I was building my bol and a ladder came out from under me.

My health insurance company paid $400, total, out of $22,000 in bills.

So while talking to a lawyer about getting them to pay, he told me that I couldn't sue myself, or my homeowners insurance.

This. If there actions did something to cause or contribute to your falling then you "might" have a case depending on the details and circumstances. If you simply fell on your own because, hey it happens sometimes. Then no they are not responsible and owe you nothing. That would be like your neighbor suing you because he walked through your yard and tripped over his own two feet and broke his leg.

And yes is seems your SIL is FSA.

Thanks for the replies.  



I never had any intention of doing anything.  My SIL started with her mouth, and every time I get up to pee and my foot hurts she makes some snide comment.




I've read some of the responses to her, and now she doesn't say anything about it.




I don't like her, my wife tolerates her because she's family.




Believe me...when I did it, the first thing I thought was "yep, I'm that fucking retarded that I fell out if a van".




Now excuse me...it's time for some ice and a hydrocodone pill.

If the business did something negligent to cause the injury, like failure to maintain the steps that lead into or out of the van, then you are well within your rights to do so. Regardless of how bad an injury may be, if I caused it myself it would never cross my mind to sue someone or something else over it.

Next time you visit SIL, if she makes some coffee, have a cup and somehow accidentally spill it on your hand.





Tell her $10,000 should cover the doctors visit for the burn, and other emotional trauma.  If she balks, tell her don't worry, her homeowners insurance should cover it.... her being liable and all since it happened on her property.



*Easier yet, just trip going in her front door or something.
