First off lets look at the word "News" which is based on the word "new".

The story cooked up by Chris Halsne - "Loophole Lets Gun Buyers Skirt Background Check" is not "News" because it is not "NEW". The legal transfer of private property between citizens has not changed since before the state of Washington was accepted into the union.

 It is not a "loophole", property rights, and contracts have been a basic fundamental right since the constitution was drafted.

 If you are in need of material for research, I suggest you look into the violation of Federal laws in regards to the illegal retention of background check information by the FBI.

The AR15 uses the same MAGAZINE as does the US Military's M16.
The device you insert into the AR15 is called a MAGAZINE.
You can load this MAGAZINE with a CLIP. A clip is what the cartridges are loaded onto.
The clip is then placed onto the magazine.
The clip is then loaded into the magazine.
The magazine is inserted into the AR15.

Federal law does not distinguish between long guns and hand guns.
There is no Federal Law that imposes a waiting period for firearms purchases.
Washington State Law requires that a background check of a prospective firearms owner be done using the National Instant Check Program.
Washington State Law does have a 5 day waiting period for HANDGUNS, not rifles or shotguns.
Imagine that.
You didn't bother to add this FACT to your "report" now did you.
Wait, it gets BETTER!
If a CITIZEN of the State of Washington has a Washington State issued Concealed Carry Weapons Permit then they are exempt for the Washington State five working day waiting period.
They can walk into ANY gunstore and walk out that same day with a firearm.

And PLEASE don't even think of telling me that your "report" is geared for the "lowest common denominator" in terms of your viewing audience.
I would rather have someone make a decision who has been informed of BOTH SIDES of the issue.

In your STORY (and yes, it is just a story, a figment of your fears and small thinking), you had a person purchase a weapon from a private party, which in the context of a person to person transfer is legal.

However, since the person bought the weapon for YOU, it has crossed the boundary to a straw purchase, which is a FEDERAL FELONY and carries up to 10 years in prison.

I would like you to answer a few questions, if you don't mind.

1. Have you ever sold a car through a newspaper ad?

2. If so, did you check the person's drivers license, and do a check to assure that they didn't obtain a false drivers license?

3. Why did you not use a dealer to do the sale?

4. Have you ever bought a car from an ad posted by a private party?

5. If so, did you subject yourself to a background check?

In the United States of America, a person is free to dispose of their private property as they wish.

The Brady Check (National Criminal Instant System background check) is for DEALERS, not private citizens.

In the state of Virginia, all dealers and employees are issued EIN (employee Identification Numbers), which allows us to access the NCIS system. Without that EIN, you are not allowed BY LAW to use the system.

SO If I were to sell one of my private guns to a person, I would NOT be allowed to use the system, because it is private property.

However, if I were to sell the same person a gun from store inventory, then I would be required to perform the background check, since I was action in the capacity of a dealer.
And that is a BIG difference, one that you anti-gun people cannot seem to grasp.

I really hope to hear your response, but I doubt that I will, which is typical of HCI, VPC, the Brady Center, and the other anti-gun groups.

I forwarded this article to the ATFHQ in Washington.  It is a felony to buy a gun for someone else with randon money.  Who gives a crap who the hippy is, do your part and copntact the ATF and complain of a felony being reported as news,,,,,,,,,,give them their just reward,,close the loophole on their asses,,,

Funny thing is that it was not an illegal purchase or an illegal transfer.

It is not illegal for anyone in Washington State to buy an AR15 from a private party and to give it away to anyone they want.

The only time it would be illegal is if the person who had bought the firearm had given it to a (know to the buyer at the time of giving it away) felon.

I called the Seattle ATF office and talked to an Agent Davis, he confirmed it after looking at the references I used.

Well - an acid tounge. Lets see what we can do here.
