The reason it's not produced in most states is because it is technically prostitution. California and Florida just don't enforce that part of the law on the porn industry.

ETA: I should specify that I'm talking about the production i.e. paying someone to preform a sex act. Not the possession of a depiction of the act.

First Amendment would make sense, but making porn is illegal in most states (including most where it is made), and actually requires a permit in most places where it is legal.

The reason has nothing to do with the 1stAm. There may be a statute or case somewhere protecting porn in some state, but I doubt it. If you pay 2 people to have sex with each other while you watch, or pay a whore to screw your brother, you have violated the prostitution laws. If you pay either or both of 2 people to screw so you can film it, you commit the same crime. As to the inevitable claim that the 1st Am protects porn "actors" and directors from prosecution for prostitution, that "rule," if it existed, would mean that if you paid A to sell cocaine to B, and paid B to buy it so you could make a film of the transaction, all concerned would be immune from prosecution under the drug laws. They most assuredly would not enjoy such immunity.

It isn't that doing it for a film is legal, it is just that either no prosecutor has thought of bringing such a case, or none has thought it would be worthwhile.

1st off - all "actors" are paid by the film producer, not one of the other actors.

However some of the more successful actors now own production companies, and are incorporated, and in such case the pay would come from the casting director which could also be one of the participants. But being a registered corp. with a specified intent of publishing adult content for resale and the appropriate biz license it is easy to argue that any sexual contact in front of a complete film crew was not personal in nature.

That's why back in the old days - the 70s and 80s, but especially the 70s, porn flicks had to have some sort of stupid "plot." That way they could be portrayed as "art" - which they are - and enjoy protection under the 1st Amendment. These were the days when porn flicks used actual, talented actors like John Holmes, Seka, and Annette Haven.

Exactly, when you start having shoot outs in the streets, used condoms on the sidewalk and syringes that's when the cops start getting involved.

Yep and there are main stream movies where a couple are doing everything but penetration, they gonna go after big time movie studios?
