The woman was married to
somebody on the outside. The man was divorced. Both of them had dementia
to some degree.

even people who are experts in geriatrics will say it's difficult to
tell whether somebody with dementia would have the right -- or -- excuse
me -- the capacity to consent to sex.

but you say that the woman called the man by her husband's name and was calmed by his presence.

There was an intimacy there, clearly. It wasn't clear what she knew at the time. And so that led to some of the questions.

If people with dementia can consent, but drunk women can't, that's fucked up.

Was told multiple times in the military that if a girl has one drink assume she can no longer consent, I didn't follow this advice but I know of people who were burned by sluts with morning after regret.

I didn't real the article, but people with dementia can consent to certain things, legally.

I had an aunt with early dementia who wanted a new will. The attorney asked all sorts of questions (Where are you, now? Who are these people with you? What is your intent with this legal document, etc.) and the will held up in probate after her death.

Moreover, if there is no clear sign of trauma in the this case, I'd would assume that it was consensual.

Years ago I worked at a personal care company that catered to people with severe disabilities. They had 2 people per house and there was alot of sexual stuff going on between certain residents (homo). It was a really awkward situation because the residents have needs, but can someone with severe retardation really consent? They didn't have the concept of discretion, so they'd be going at it in the common areas and there were times staff would walk in on it

The most "active" people were wards of the state, so family wasn't really a concern.

Reminds me of when my wife worked as an RN in a nursing home. There was an elderly man and woman both with dementia, that ended up marrying each other. He ended up starting on Viagra.

The nastiest part was when the lady would ring her call button asking for an aide to come wipe up "the mess" when they were finished.

Even worse is that it doesn't work the other way around either. If both the man and the woman are drinking, she can claim impaired consent. If he tries it will be treated like drunk driving where compounds the crime, not mitigates it.
