This dude was drunk and deserved to be arrested, but I've always heard your don't strike above the shoulders with a baton, it makes a distinctive sound when he gets smacked. This happened Saturday at the parade, about 200 yards from where my tent was setup. I like how the off duty officer tries to take the phone at the end of the video. The baton strike put 8 staples in the guys head..a whole bunch of in this video

JACKSON, Miss. -
A Jackson police official said an officer caught on camera hitting a man with a baton during an arrest at the Mal's St. Paddy's Parade acted appropriately given the "volatile situation."

While the man who was hit admitted he used a racial slur, Zach Magee, 22, said police went too far.

Magee said he had gotten into a fight with strangers. Police stepped in moments later, and Magee was struck.

The incident was caught on cellphone video that showed a drunken Magee mouthing off to police at the St. Patrick's Day parade in Jackson.

Magee's father tried to talk him down, but he was pushed away moments before the baton can be seen being used on the video.

"They got me from behind in the back of the head with the night stick -- with his metal stick and split my head open about 5 inches," Magee said.

Magee said police first approached while he was fighting with two other men. He said a Jackson police officer slapped cigarettes out of his hand. He admitted what he said to police landed him on the ground.

"'F you, n-----.' I guess that's what I said," Magee said. "But they reacted to a racial slur inappropriately."

Jackson Police Assistant Chief Lee Vance said Magee was charged with disorderly conduct, assault on a police officer and resisting arrest.

"This individual had been in a fight with two other people when police were called to that particular scene. When the officers got there, they tried to subdue him. He wanted to fight, so he subsequently got placed under arrest," Vance said. "Officers had to take him to the ground and place him under arrest."

Vance said from what he's seen on the video and in the police reports, the officers responded appropriately.

"It was a volatile situation involving an individual who was highly intoxicated, and due to his prior actions, apparently came to this event wanting to fight," Vance said.

Vance said he doesn't believe the officer intentionally hit Magee in the head with the baton to intentionally do him harm.

"I think if you've ever been in a fight -- which I've been in lots of them -- sometimes what you swing at, you don't necessarily hit," Vance said. "I think it was our officer's intention to get this guy under control so he could place him under arrest. I don't think there was any other motivation other than that."

Magee said the injury required him to get eight staples in his head. His stepfather said police could have killed him.

"If all police (are) like that, then all our kids -- they're going to be in graveyards," stepfather Ayman Albataineh said.

Magee admitted he needed to be arrested.

"I should have been arrested and not hit in the back of the head," Magee said.

Magee's family has hired an attorney and plans to meet with officials in the Jackson Police Department's Internal Affairs unit.

If you're swinging away and the dude's jukin and jivin and he gets hit in the head, oh well. Targeting the head is lethal force. Hard to see what else he was aiming at. Looks like a good opportunity for a choke, if that was an option at his department.

Looks like the cop was going for a suprascapular stun (sp) and the guy's head go pushed back in the way. Good tactic? I wouldn't do it, would have started with a common peronial (sp) strike, but not intentionally targeting head as far as I can tell. But still a whole lotta going on. No baton should have been necessary with that many cops.

I was taught that a blow to the head with baton was considered lethal force. Not justified in that situation but last news article I read JPD said the office acted appropriately.

Looked like he punched him in the head, then extended the baton. Hard to tell, but I'm not sure he actually hit him in the head with the baton.



The dipshit trying to take the camera could have used a baton to the head though.

Striking the head from behind??  I don't think so.  Take him down, cuff and arrest.  Any blow to the head can be fatal.  

You can almost feel it in the air.  The American people are getting restless.  The time is soon coming that people aren't going to put up with this kind of brutality.  A bigger crowd around them, it might not have gone down like this.  

I support the police, but they are trained professionals, and should be held to a higher standard of behavior.  I don't see where this meets that.  He should be fired.

Have you ever swung at a ball and missed? Well, like the ball, people can move. The guy ducked, or at least appeared to. I still can't say that is where the guy was hit. The loudest sound I heard was actually the elbow. Much louder than the head hits.  

As for what you feel about restlessness, you are dreaming. This isn't the riots from the 60s or 70s. The cops were brutal back then and law enforcement is nothing in comparison. If this had been back then, the guy would have been in the hospital before the camera came out. Those days the police were violent and violated rights.

But, hey, let's not stop a usual GD dogpile.

This was JPD that in bold is I personally know an officer that didn't get fired until his third DUI in uniform in his cruiser, yes third. Have you not heard, you can't question an officer, their infallible you silly citizen

His target was probably the mans upper arm area but he missed due to all the movement from the pushing and shoving.  

Use of force isn't an exact science nor is it pretty. The man in the arena gets the benefit of the doubt in my book.

One blow, during a scuffle, will 99% of the time be found to be justified, unless the officer claims he aimed for the head.

Jpd has been a joke for decades. My father was shot when we lived I'm Jackson, funny how the charges where dropped because the shooter didn't match the suspect who raped the neighbor ten minutes prior.  I guess if you can't link all the crimes then you let them all go.

I'm not taking any sides on this one.  Not a hater or apologist.

I think the plain cloths officer could have taken a different route other than being real up close in the guys face... Drunk people tend to respond violently when people get all up in there face and start yelling.. Add that he was not in uniform and asshole was drunk off his ass...

Not a big deal but maybe could have caused things to not go hands on..

I understand its hard and options limited.

He didn't exactly have a lot of a target area open to him.  Any horizontal strike would have hit someone else.  A vertical strike to get around the head that's moving is tough.  Doesn't look good, but uses of force never look pretty.
