so I changed jobs recently and 1 week after I started another guy started. He made a point of making my life a misery because of my nationality. Typical inmate style stuff. I need the job but I cant take the stress of him threatening to punch me in the face etc. which I have basically ignored. now today he claims I vandalized his car and said if I dont come out side and sort it out like a man then he will call the sheriff.
so I went to the boss and informed him of whats going on and he said that I must ignore him and get my work done. I went back to work but I cant take his verbal abuse. Should I just quit? Also he has 3 other relatives working there update I dont know what the correct action would be in this situation. where I come from no one calls the cops or its the last choice. I went into the office and quit today the boss said have a nice christmas and see you tuesday morning. |

Document and record, then go over your bosses head and talk to HR with documented proof of threats of violence.

He did nothing so now you go to HR. |

Not that it matters one iota, but what nationalities are we talking about?

Call the cops before he does and let them know you're being physically threatened. |

Record. Have a lawyer handy for that discrimination lawsuit.
Did I just say that? On a more serious note, I'd just quit if it's a small joint like that. No good can come from it. |
|
File a restraining order against him for threatening you. He'll probably have to quit.

the boss is the owner and HR etc its a 12 man operation Start looking for another job. Or, let him assault you then sue the boss for not responding to your complaints about threats of violence in the workplace. Document everything with times, dates, and names and the exact wording. |

Quoted: If you quit, he wins. Constructive discharge. All laughs about the employee who "couldn't take a joke". That is, until the lawyers figure out the owner/HR are one and the same. Then the shit gets real. |

"Hostile workplace".
Those are the words that make HR shudder. |

Try ignoring the perp for a while, and I mean ignore in every way. Do not acknowledge him in any way. He'll either get tired of bullying or escalate to a physical assault. Tell the boss what is going on, and reiterate that until he "gets it" and decides to fire one of you. I'll guess he ain't too smart about the consequences and is probably betting no one is going to elevate the situation to a lawsuit. The trick there is to get the state to do the dirty work.
Probably should hunt up a new job. ETA: Arkansas, "the Huge", and "I can read the prints"; I have a good picture of just what you're facing, and I'll bet my assessment is over 90% correct. You're up against your basic ignoramus and a southern racist to boot, and most likely he's a coward that will fold like a cheap lawn chair when confronted by someone that is serious about rearranging his face. But that's no fun, you might get a cut and get blood on the prints. Get a Taser and give him a tickle. |

With 3 relatives there, probably ganging up on you, be very careful you dont have an 'industrial accident' and get injured.
Does the boss/owner condone/see any of this happening, or is it all he said/he said. Any security cameras? Other witnesses? Do you 'fit in' with the rest of the crew, or are you a 'loner' that nobody talks to? Watch your ass. As stated above, with only 12 employees, its gonna get rough. |

I am a machinist and I basically run half the shop (not by my choice) including 1 of his relatives. I am the person every one comes to for parts or help with their problems because I can read the blueprints. |

"Hostile workplace". Those are the words that make HR shudder. This, definitely. If management has been informed that there is an issue and they fail to address the situation, this fits the criteria. If HR then does nothing to correct it once they have been apprised of the situation, well lets just say that those are the situations that attorneys who specialize in workplace litigation love. |
|
Small business owners who ignore complaints of hostile work environments will pay dearly for their ignorance. Not your fault he's ignorant but he will need to be shown how expensive that ignorance is if something happens that he should have prevented.
Record what you can. Video is better than audio. Watch your arse and forge ahead, do your job, and keep your head down. If someone assaults you in the workplace start planning on a big bonus. |

The guy works in a little shop where the owner is boss and everything else. He has to make the owner understand that despite the good old boy ways still in effect in that part of the country, there are modern legal complications that mean he'd better sort this problem out before The Man gets invited to the party and upsets the peace and tranquility of life.

Op, you would fit in just fine down here in south LA. If you get fed up start looking for oilfield jobs.
