A man with a trailer is parked unloading debris from is trailer.  As he is finishing up, another car backs in next to him.  Man walks to truck and starts to pull out, but he didn't not see that the 2nd man had open his rear door and it was in the path of his trailer.  So he pulls out and the trailer catches door opening it further than designed.

Vehicle A was towing Vehicle A1 when it struck Vehicle B which was stationary. Typically it's the moving vehicle's fault.

Driver B may be a dumbass for not being observant and considering the inattention of other drivers, but Driver A is at fault.

Whenever you see someone loading/unloading a trailer or other such occurrence, give them room. It's common sense.    Even if in this case the guy with the trailer will be found at fault.

If one vehicle was stopped/parked, it's the moving vehicles fault.

If you are moving and he is not then YOU are responsible for anything you run into, even if you are going backwards.  Trailer drivers have to be extra responsible to make sure the area is clear BEFORE moving the trailer.

Lots of people tow trailers that have no business towing ANYTHING.  I give trailers/5-wheels, etc a wide berth.

I'm guessing that OP is the sole vote that thinks he's not at fault.

Whenever I unload debris, I always walk around my truck to make sure that I didn't leave a shovel or broom somewhere or any other things( ropes, tie downs, etc) or that some jackass didn't park too close to me with his door open.

I didn't vote.  How do you know I'm the trailer driver?

No option for George Bush's fault?

The vehicle in motion is at fault.

What gaps?  That's what happened.  Driver B opened door into driver A path.

Good lord how could I forget those.  Nothing like somebody who can't navigate a honda civic behind the wheel of a 26' box truck.

No. Driver B did not open it's door into driver A's path.
The parked vehicle has no "path" and has no right of way when leaving a parking space to enter a roadway.

If Vehicle A was in motion and driver B opened his door into Vehicle A's path then driver B would be at fault.

If the trailer guy had already starting to pull out while the guy opened the door I oils say the guy that opened the door would be at fault.

If I was driver A there is a good chance that I would be fired from my job of 25 years if it happened on the job.
