Tina's egg was fertilized with donor sperm and implanted in her partner's womb. But when their romance fell apart when the child was 2, the Florida courts had to decide, who is the legal parent, the biological mother or the birth mother who carried the unrelated child for nine months in her womb? A trial court summarily sided with Tina's ex-partner, citing Florida statute. "The judge said, 'It breaks my heart, but this is the law,'" according to the birth mother's lawyer, Robert J. Wheelock of Orlando. But on Dec. 23, a state appeals court rejected the law as antiquated and recognized both women as legal parents. Maybe a dupe, but haven't run into a thread yet, so what the heck. ETA: changed title to garner more interest.

I do know a lesbian couple who have a child together. Not married, but living together. The mom (artificial insemination, but she actually gave birth) decided to move out and leave the state. The live-in girlfriend went to court and the judge kept the mom from leaving with her child. She had to stay and give the girlfriend visitation. Very interesting. |

Hell most states are still trying to work out surrogacy issues much less parental rights between same sex couples. Absent direction from legislatures courts are going to have to figure this out. It's shitty because there's kid's involved. Regardless of whether you agree with same sex marriage, family law needs to catch up. No kids and samesex couple separations could be handled by contract law. Oops didn't get that in writing Adam and Steve tough. |
