Lets leave out something important from the story

Reininger posted $100,000 bail and was released from the county jail four days after his arrest. He did not return to New Jersey, but was told the trial would happen without his presence. The two-day long trial was held in Flemington in August 2010 before Superior Court Judge Stephen Rubin.


Faced with those kinds of charges, you'd want to show up for your trial. Little sympathy for anyone who fails to do even that.

Federal law says: In your trunk, in a case, unloaded, and separate from your ammo. So long as your just passing through and not making extended stops.

NJ and some other places don't always care about 1986 FOPA though.

No, FOPA says you can travel with firearms as long as your legal in your origination and destination of your trip, provided you do not make unessescary stops.  Though some states really don't give a fuck, and think that you should drive till your out of the state.  As an example, NYC is notorious for arresting people because their flight gets delayed or canceled if they have a gun, cause thats an unnecessary stop.

A simple Google map search shows he was about 30 miles from the PA line.  If he was in fact moving from Maine to Texas, that was a pretty stupid route (he probably went through MA and NY - you can't avoid NY).  And if he was off I-78, that location makes no sense.



And he was a dumbass not in compliance with FOPA ( 18 U.S.C. § 921). Here's a clue - if the township fuzz can see your guns in Joisey, you're getting arrested and FOPA won't save you



He's pretty much a dumbass all the way around.  Not a poster child for RKBA or FOPA.



If dumbass had had a U-Haul (truck or trailer) with the unloaded guns (all of them) in the trailer (or back of the truck), he would have had a chance (depending on what the status of the DV charges are).  



Is NJ a communist socialist anti-liberty state?  Yes.  Does the stench of its tyranny offend me?  Yes.  On the other hand, (1) live an outlaw and go down guns blazing just to drive through there or (2) be scrupulously in conformance with FOPA (or (3) just avoid the place entirely)?  



Dumbass chose "none of the above."  I vote for (3).

Was he smart, nope, did he do anything that caused any harm, monetary loss, or loss of another persons rights? Nope. Just an asshole state and an asshole cop out to ruin a person's life because he had some guns.

I had a job offer up there in a not so good area. 120k yr.

Looked into it and was leaning toward taking it until I started asking around in the Jersey HT forum.

I had heard the stories but I thought Hell, it can't be that bad.

Asked about CCW and vehicle carry and was told that there are only 2 kinds of people up there with guns, cops and crooks.

Was told OMG, you don't want to be caught with a gun there.

Hell, I wouldn't be caught without one there.

Didn't take it and don't regret it.

5 years in state prison, and loses his right to own firearms forever? Something is seriously fucked up in this country. Although he put himself in a bad spot, it's complete bullshit that in AMERICA you can go to prison for simply possessing a firearm in certain states.

If I were in compliance with FOPA, yes, I would bet 5 years of my life on it.  The chances of being found not guilty are greater than the chances of Texas not extraditing.  If the State of NJ found me guitly, well, that is what the appeals process is for.  The NRA also likes to be involved in groundbreaking cases.

He didn't go to jail for "simply" possessing a firearm. He didn't adhere to guidelines for traveling with firearms through unfriendly states. having them visible in the vehicle is a no no, right off the bat.

Furthermore, not showing up for your own trial pretty much disqualifies you from complaining about your sentence you receive.
