"A Texas Death Row inmate whose lawyer slept for long portions of his murder trial will either win freedom or a new trial, after the Supreme Court refused to intervene Monday.
The high court rejected an appeal from Texas authorities, who argued that the lawyer's inattention did not necessarily equal an unfair trial. "
Too bad-I was hoping for a ruling from the Supreme Court that it was acceptable for an attorney to sleep through a Court appearance, I'm kind of tired myself and I do have night court tonight.
I had a judge sleep through a personal injury trial once. He was out for about 10 minutes-the other lawyer and I just kept going, he woke up before I had to object to any of the other attoney's questions
I also had a juror nod off once-I can't blame him-that one was a sleeper.
