"A Texas Death Row inmate whose lawyer slept for long portions of his murder trial will either win freedom or a new trial, after the Supreme Court refused to intervene Monday.
The high court rejected an appeal from Texas authorities, who argued that the lawyer's inattention did not necessarily equal an unfair trial. " Too bad-I was hoping for a ruling from the Supreme Court that it was acceptable for an attorney to sleep through a Court appearance, I'm kind of tired myself and I do have night court tonight. I had a judge sleep through a personal injury trial once. He was out for about 10 minutes-the other lawyer and I just kept going, he woke up before I had to object to any of the other attoney's questions I also had a juror nod off once-I can't blame him-that one was a sleeper. |

May it please the Court ~ Your Honor, I would like to make a motion that the lights be dimmed in the courtroom just a tad. It is my opinion that this Courtroom's glaring and unrelenting lights are simply compounding the gruesomeness of the coroner's death scene photos of the victim and possibly denying my client a fair trial based upon the undeniable prejudicial effect that such photos might have on the minds and emotions of the jury. Accordingly, I move that the lights be dimmed in this room immediately! I wonder what the honorable judge was doing while the defense counsel slumbered away. He should have woken him up and kicked him out of the courtroom and had him disbarred for life.
What kind of damn fool sleeps through his client's death penalty case? What kind of damn fool judge allows that to happen? The sad thing is that the felon is guilty as hell, and the taxpayers will have to pay for a new trial with the same ultimate result. |
