[b][blue]May 23 (AP)[/b][/blue] — A federal appeals court says a California inmate has no right to mail his sperm from prison to impregnate his wife.  

The Ninth US Circuit Court of Appeals says inmates have no constitutional right to procreate. Ruling six to five, the San Francisco-based court put a halt to inmate William Gerber's plans to ship his sperm to his wife in Southern California.

The US Supreme Court has said prisoners have a right to marry and be free from forced sterilization. But neither the high court nor any lower court had resolved the question of whether inmates can procreate.

The Ninth Circuit last year ruled that Gerber had a right to procreate via the mail, but changed its mind today.
