City to pay $40,000 to man shot by off-duty cop

He said Officer Abel struck him in the back of his head with a gun. Mr.
Miller said that as he moved his right hand behind him to protect his
head, the gun went off.
The city suspended Officer Abel, but an arbitrator reinstated him.

$40,000 sounds pretty cheap for getting shot.  

Wonder what kind of asshattery Mr. Miller was up to that required his being smacked in the head by the officer?

ETA: After reading the articles linked below, apparently the asshattery belongs entirely to Officer Abel.  $40k still sounds cheap, though.

He sounds like a fine Officer.    
Of course, he was also drinking at the time, so he didn't even get hit with DUI charges.  __________________________________

You can imagine the scene down at police headquarters: Officer Abel
trying to make his colleagues understand that the shooting of an
innocent man was an accident and the pistol-whipping he administered to
the victim before shooting him, well, was unfortunate, but
understandable in all the confusion. And it wasn't a racial thing,
either: Both Officer Abel and the victim are white.

Saturday's incident started when an unknown man punched Officer Abel
as he and his wife sat in their car at a stoplight, Chief Harper told a
news conference this past weekend.
While his wife ran back to the Town Tavern to get help from off-duty officers working there, Officer Abel retrieved his gun.
At South 20th and Sidney streets he encountered Kaleb Michael Miller,
20, a pedestrian whose clothing did not match that of the two men who
had approached the officer's car. Officer Abel hit Mr. Miller in the
head with the butt of his gun, witnesses told police, and the gun went
off, striking Mr. Miller's hand.
Mr. Miller was taken to UPMC Presbyterian and was later released.

The suit claims Officer Paul Abel Jr. and Miller got into a fight in
June of 2008 because Abel mistakenly believed Miller was the man who
attacked him outside a bar.





In June of this year, Allegheny County
Judge Jeffrey Manning found that Abel, 35, exercised poor judgment but
ruled that Abel was not guilty of aggravated assault, drunken driving
and reckless endangerment. Abel was reinstated with the police
department last week after arbitration.

Of course he's back on duty now.  Don't you feel safer Pittsburgh?

Must have been an extremely weak lawsuit if he settled for only $40K.

Edit: But from reading the sensationalized news reports the Officer appears to be a dickhead.

Heck, the city here gave some woman 180K when she was hit by an ambulance. (Minor injuries)

What rest of the story?
1.  Drunk off-duty cop.
2.  Pissed off, drunk off-duty cop goes looking for the two folks who jumped him.  After getting his gun.
3.  Pissed off, drunk off-duty cop accosts an innocent person, (That doesn't even meet the description given witnesses.) pistol whips him, and in the process negligently discharges a round through the innocent guys hand.
4.  Pissed off, drunk off-duty cop tries to explain his actions to his fellow officers, is charged with multiple violations. But miraculously is cleared of all charges.  Imagine that.
5.  Innocent dude has a hole in his hand, and a whole whopping $40,000 for it.  Plus he gets to know that the dumb-fuck that attacked him is back out on the streets.  Protecting and Serving indeed.

At a hastily called news conference on Sunday, Pittsburgh Police Chief
Nate Harper announced that Mr. Abel had been removed from duty without
pay pending a thorough investigation. "The gentleman who was in the
physical altercation [with the officer] is an innocent victim as far as
