if i do a little smithing in my home and the owner stays with his firearm while i work on it can i do it without a ffl?

I dont think you need and ffl for gunsmithing, only manufacturing or selling.

In that situation, you can probably get away with not having an FFL, but you can never be too safe when the ATF is involved.

Yes. A person conducting such activities as a business is considered to be a gunsmith within the definition of a dealer.

If you are making money working on someones firearm, you are in business, and are subject to ATF regulation.
