Just keeping you up to date ony legal situation. My mapp hearing is scheduled for tomorrow and this could be my best chance to get this case thrown out of court. I don't know much about the format of mapp hearings but my wife and children are supposed to testiy as well as myself. We are not too happy about bringing the kids into this nightmare so I will request that they be left out of the proceedings. They did not see my arrest(Thank GOD)and I just don't think that they should be dragged into this. As far as my wife is concerned she is a very eloquent speaker and very intelligent to boot. She has a lot to say about the incident and some people just have that way of getting every one's attention when they speak. I will be questioned by the prosecutor, judge and my attorney. I will also be required to tell my story for the first time before the judge who will hear my side then the prosecutors side before making his determination on dropping the charges or going ahead with a trial. The whole situation depends on good solid testimony from me and of course a sharp legal mind like that of my attorney. I will let you know some time tomorrow afternoon how everything turned out. Thanks for everything, you guys have been backing me from jump and I will do my best to represent the gun community and AR15.com in a positive manner. Thank you.

Go for it bro. I take it by "Mapp hearing" this is a suppression issue pursuant to Mapp v. Ohio? What happens next if the "evidence" is not suppressed? Plea offer available, and if so what is the exposure and terms? Exposure if there is a conviction through trial?

Good luck, my friend. I know you'll be glad not to have this hanging over your head. I'm sure you know (and your lawyer has told you) how to best present yourself in court--very clean cut, harmless, mild mannered, neat, well dressed, preferrably clean shaven, polite, etc. I have thought of this often, so I appreciate the update. I hope your post tomorrow gets tacked so I don't miss it. Best wishes, and I, for one, am still interested in the idea of a defense fund, even though you have refused in the past. Good lawyers are not often figured into the family budget. Think about it. If some of us kicked in $20.00--$50.00 we could have you "square" in no time. We know you are an honorable man, and that's all that matters. Your character is admirable. Again, Godspeed. [:)]

[b]'Exposure'[/b] means what kind of penalty are you facing in the event that you're convicted.
Who asked that your children come to Court? The state, or your attorney? Always remember - the other guy is smarter than you are. Chances are he's not, but it always helps to keep things in perspective. Sometimes the smartest people make the worst witnesses, because they 'know' where they are being led, or think they know where they're being led. Then a right hook comes out of nowhere, boom! Rehearse what happened so that you and your wife's stories are the same. Trust me, the witnesses will likely be sequestered and ordered not to speak to each other about the case. You will always be in the courtroom, but your wife likely won't. She'll be with the other (Police) witnesses outside in the hall. This helps the witnesses tell the story the way they perceived it happened and not the way they just heard it described as happening. So if you and your wife's story conflict, there will be no time to correct the facts once she's placed on the stand. A word on Exposure.(Thanks ETH) While they have not yet suggested a penalty, the worst case scenario would be one year prison time along with a fine. This is highly unlikely though, but I still must consider this a possibility when making decisions concerning my case.

BTW - was the stungun functional, and how did they find it? I remember going thru everything, but I don't recall all the details right now... Count me in for the LD fund if it becomes necessary. Best of luck one shot. I didn't get to read the original story but this sounds absolutely ludicrised I can't believe people would keep electing those people. Again good luck. Count me in on the fund as well this BS is grounds for a fight, and if you need me I'll be right beside you.

Be sure to go over your testimony with your attorney ahead of time. You need to know what his goals are in having you and your wife testify. What is he trying to get out of you and what do you have to be careful of on cross examination, what is the persecutor going to try and get out of you?
Testifying, particularly on cross examination, is tough, you want to be wary of saying the wrong thing yet still come across as being honest and forthright in front of the judge. Good luck! |

I am not aware of your situation but all I can say if you do go to prison remember no matter what the issue is don't let anyone PUNK you for your stuff. Always fight for your stuff in prison no matter if you know you will lose. Winning or losing is not what is important, all that matters is you prove to some predator that you will fight for your shit and if you do the predator will move on to the next guy.
Otherwise good luck. No, I have never done any time, I happen to know what to do in prison because my job depends on it. Again good luck. |

Offering a prayer to God is a kind act of thoughtfulness that many believe works and helps, so why would you go apeshit over that? You were out of line, IMHO.
