PITTSFIELD >> Well over 100 gun rights advocates and supporters turned out Friday evening for a rally at Park Square, coming to protest state Attorney General Maura Healey's move to prohibit the sale of rifles she said violate the state's assault weapons ban.
Joining the protesters, most of whom appeared to be Berkshire County residents, was Jim Wallace, director of the Gun Owners Action League, whose organization promoted what was billed a "2nd Amendment Rally." Healey is "retroactively trying to turn people into criminals," Wallace said. The AG announced on July 20 that gun manufacturers were making slight changes to semi-automatic rifles that made them noncompliant with the state's 1998 assault weapons ban and ordered a halt to the sales. In the last 24 hours a new page has shown up on Attorney General Healey’s website, titled “Guns That Are Not Assault Weapons”.
Upon viewing the page there are many new questions, which make this untenable situation increasingly murky. This is disturbing considering that Healey has threatened gun owners not in compliance with a ten-year felony charge for transferring items that are legal to transfer according to Mass General Law (MGL). By her action she has put licensed gun owners and dealers in a tough spot, should they follow existing law as outlined by the MGL and recognized by the courts, or should they follow the enforcement notice and fear the threatened ten-year felony charge? Questions for a friend of mine in MA:
Does this new AG decision only deal with post-ban guns? Can he have a pre-ban rifle/lower transferred to him? He is trying to purchase a preban AR and his local FFL told him that he wouldn't transfer it and that nobody in the area is touching them. Anyone know of an FFL in the Stow area who would do this transfer (assuming it's legal and verifiable preban of course). Thanks very much! |

Healey's "clarification" made things far more muddled than they already were. Some shops will, some don't want anything to do with them. I know several shops in my area that will. Massachusetts Attorney General Maura Healey on Tuesday asked a federal court to dismiss a lawsuit brought by four Massachusetts gun shops over her crackdown on "copycat" assault weapons.
The four shops' lawsuit alleged Healey's crackdown, first announced in July, was "unconstitutionally vague, invalid, and unenforceable." Anyone know if lowers/ rifles that were FA-10'd prior to the AG's "directive" are still good to bring back in to MA if they have been brought out of state and the state was notified/notified of an address change for my LTC(should be void now.)?
I have no plans to move back to MA in the next 5-7 years and I hope you all fighting the good fight come out of this with a victory, however I would like to know what your thoughts are on it should I be moving back even though If I end up back east, I'd like to be north of the border. |
