McKinney says officer 'instigated' incident
Congresswoman's lawyer blames incident on race

WASHINGTON — Rep. Cynthia McKinney on Friday said she was the victim of a racist Capitol Hill policeman who used excessive force when she became involved in a physical confrontation with him Wednesday.

"The whole incident was instigated by the inappropriate touching and stopping of me — a female, black, congresswoman," McKinney said at a Washington news conference, jettisoning the apologetic tone she had adopted earlier in the week.

Two lawyers representing McKinney said they will press for an investigation of the white police officer involved in the Wednesday incident even as Capitol Hill police are determining whether assault charges should be filed against the DeKalb County Democrat next week.

Police said McKinney struck the officer when he tried to stop her as she attempted to walk around a security checkpoint. Members of Congress are typically allowed to skirt checkpoints, but police said the officer failed to recognize McKinney, who recently changed her hairstyle, and that McKinney was not wearing her congressional lapel pin.

Attorney James Myart, appearing with McKinney at the press conference, insisted the incident was not McKinney's fault.

"This case has just begun," said Myart.

In a statement issued prior to the news conference, he said McKinney was "just a victim of being in Congress while black" and "a victim of the excessive use of force by law enforcement officials because of how she looks and the color of her skin."

Several Capitol police officials have said the officer involved asked McKinney three times to stop. When she did not, he placed a hand on her and she hit him, they said.

A statement from McKinney's office said the officer "body-blocked" her during the incident. But Michael Raffauf, an Atlanta attorney representing McKinney, said she had not seen or approved the statement, and that it had been issued by mistake.

Capitol Hill police declined to address the accusations.

"We're currently investigating the matter. That's as far as it goes with us right now," said Sgt. Kimberly Schneider, a police spokeswoman.

But officials of the Fraternal Order of Police, the union representing the Capitol police, denounced McKinney's tactics and said the officer involved, and not McKinney, was the true victim.

"There's no excessive force here," said Lou Cannon, president of the FOP's Washington, D.C., chapter. "If she's trying to turn this into a racial issue, people should ask, 'Why is she doing this?' This is an insult to all police officers."

The FOP's national board, meeting Fridat in Nashville, unanimously approved a motion commending the police officer, who has not been identified, and condemning McKinney, who was stopped because the policeman didn't recognize her.

The motion was introduced by Bill Peacock, a national delegate from Georgia, who said, "I don't know how she can defend her actions."

"There were two avenues she could take, one being the high road — admitting her error — and the other is to use the race card simply because the officer was trying to do his job," Peacock said in a phone interview from Nashville.

At the press conference, McKinney was surrounded by children from South Georgia's Coffee County who held signs reading, "Is Cynthia a target?" and, "Recognize our congresswoman."

Hal Pressley, an NAACP official from Coffee County, said the NAACP had brought the children to town in part to visit with the congresswoman.

"For Miss McKinney not to be recognized by the Capitol police officer was, in itself, an insult," Pressley said. "She's recognizable all over the world. So in D.C., our capital, you would expect that almost any police officer would recognize her with all the controversy that's been attached to her name."

Also appearing at the press conference were singer and activist Harry Belafonte and actor Danny Glover, who said he was there "to support our sister."

Another influential African-American, Rep. Juanita Millender-McDonald (D-Calif.), came to McKinney's aid Wednesday night. Millender-McDonald, the ranking Democrat on the House Administration Committee, which oversees the Capitol police, called the House sergeant at arms, Wilson Livingood, amid rumors that McKinney would be arrested, her spokeswoman, Denise Mixon, said Friday.

Mixon, however, denied Millender-McDonald tried to prevent an arrest.

"The congresswoman did not intervene. All she did was ask a question: 'Where are we now?' " Mixon said.

She said the conference call also included McKinney and Tad Vandermeid, legal counsel to House Speaker Dennis Hastert.

Mixon said Livingood did not specifically address whether there were plans to arrest McKinney, saying, "An investigation is going on." Millender-McDonald asked to be kept abreast of any developments, and Livingood agreed to do so, Mixon said.

If she hit a cop it shouldnt matter who she is or what she does, she should be arrested and tried just like any one else who assaults an officer.  If I walk up to any cop and slap him/her guess what boys and girls, I go to jail and yes I believe that is a felony.  But because she's a member of congress no charges and no arrest.  I say the officer should sue the daylights outa her for assault.  What a moron and Chainshaw, I'm with you 100% on the sentiment of that woman.

The fact that they didn't arrest her on the spot should tell you something. If that were John Q Public they would still be in jail.

Laws on the books prevent arresting certain politicians "on the spot" when their branch is in session... I'm with you in that I am 99% certain that she will get NOTHING out of this when all is said and done. Just pointing out that certain politicians can't be arrested or hindered by LE under certain circumstances.

HK- apparently that's not exactly the case. They have immunity from being arrested on the spot, but not from being charged and what not.

I heard on the radio this morning that the Capitol Police are filing charges against her for assaulting an officer. She is to give a statement this morning as well. I hope they arrest her while she's on camera.

Better pay more attention in civics class.  She can not be arrested while traveling to an active session of congress.  She can most certainly be arrested after the Congressional session recesses.

Last cycle, when the fools put the fool in again: only 112 individuals this time, maybe there are some with shame

open secrets website has statistical data, FEC site allows you to pull all donors, individual or PAC.  you can also search by donor if you want to see if you who your neighbor or boss or whoever is supporting

During the "9-11" cycle, only 5 names out of over 100 were non-arab in the "A" section. That is eye-opening. Good post, cohutt.

Maybe I'm looking at the wrong place, but I only saw a handful of Middle Eastern names.  Most were unions, or large employers.  My current employer gave her $100, and a former employer gave $500

I may be naive,but I am more disturbed by the high percentage of the donations from states other than GA or even the Southeast.
It really draws attention to  the fact she doesn't really represent the gerrymandered district she "represents".

At least my bil didn't donate any money to her.

I listened to boortz at lunch today and he said she had brought a bunch of black school kids in to the university where she had her press release. These kids were touring the capitol. They had been given signs that said "recognize our congresswoman" and such.


That the parents of these children aren't outraged that their kids were pulled in and used an political pawns just eats me up.

this idiot is trying to martyrize herself.  She's trying to sell herself off as the modern day Rosa Parks or Harriet Tubman.

Coming from the NAACP, it just doesnt suprise me.  This whole situation is so typical its honestly not a shock.  Lets scrutinize the facts:  

1)A black woman decides she DOESNT want to follow the rules and when called on by an LEO acts out however she feels.

2)After commiting a FELONY, this said woman is now acting like SHE is the victim.

3)The NAACP is now supporting this woman and condoning her FELONY actions because and only because of the color of her skin.

The cop isnt the racist here, Cynthia is.  Bottom line.  And the last thing quite honestly, take a walk through the prison's, they all act the same way she is right now after getting caught, their the victims and NOT to blame for anything or their actions.

Common sense left the building a very long time ago.

If that's a direct quote, she still didn't say she's sorry.

There is a marked difference in " I apologize" and "I'm sorry I struck the officer".

I learned long ago that "I apologize" is absent of personal accountability. It's simply saying the same thing she said in the first place. She regrets that the incident occurred.

If I were a black man, there is no way in hell I would want this scumbag representing my culture or my race.

And to go further, what kind of example is this idiot teaching the youth that she manipulated into "starring" in her press conference?! That it's alright to strike law enforcement!

I hope she gets a felony charge and gets booted. She never was fit for office.
