Phoenix (AP) -- Police investigating a fatal hit-and-run accident served a search warrant Monday at the home of Bishop Thomas O'Brien, the head of the Catholic Diocese of Phoenix, police said.

Phoenix police Sgt. Laurie Williams said police were investigating an accident on Saturday night in which a man was killed after being struck by two cars. Both cars fled the scene.

Witnesses gave police a license number, which led investigators to O'Brien's house, Williams said.

"The bishop has been speaking to our investigators and he's been cooperative," Williams told television station KTVK.

The station also showed footage of the bishop opening his car for detectives.

Calls from The Associated Press to police, the county attorney's office and the diocese weren't immediately returned Monday.

That time of evening the twilight & shadows are terrible depending on which way you're traveling - plus the fact the dude was jaywalking.

I'll bet neither the Bishop nor the other driver ever saw anyone in the street and probably never felt much. Maybe the first hit was a bump or graze that knocked him into the next car.

Ahhhhhh Yeah....
didn't see him. I guess it was hard to see out of the windshield, since the guys head bounced off it. Half his fucking windshield was smashed in. How do you not know you hit someone. The guy was over 6' 230lbs. Not like he hit a cat.

I heard a blip on the radio indicating the muther fucker placed a call to get the window fixed, and the judge set his bail at 45k. He was scolded by the judge for waiting til the po po contacted him.

Rome beleves that this is nothing more than a attempt by the Protestant churches in the US to discredit the Catholic church. Their persecution complex is full on. It doesn't help that the Pope has surrounded himself with so many African and Latin American cardnals for whom this kind of behavior is the norm for clergy back home. And who have been raised since birth to hate the United States.

I hear he might only get probation!!! Fucking probation for killing someone, not to mention covering for pedophiles!! I don't care what kind of deal he made regarding no charges for the pedophile debacle, he needs to go to prison!

Thats the beauty of the scam called religion. You just have to repent and beg for forgiveness. Do what you want, just admit it and all is good.

He had to be DUI. What "good christian" wouldn't stop to lend emergency aid to someone HURT BAD... even if you are the mother fucker who just hit him? Nahhhh, this chump is evil. He is NOT in anyway a man who carries god or the fear of god in his heart. He has absolutely no conscious at all. He didn't even have regrets later after the adrenaline rush was gone. He simply called to get his windshield fixed. What a fucking prick!

The cops say the reason the bishop might get probation or up to 3 years in the pen is because the guy killed was J-Walking, he was esentially committing a crime. Had he been in a crosswalk, the Bishop would be tried for manslaughter...But, the cops also said that they don't know which car actually killed the guy...

Yep...the bishop needs to know what it's like to have his pee pee played with by someone who shouldn't be playing with it..Maybe then he'll know how those young boys felt and still feel today.

Damn I am glad I never became an altar boy when I was a kid...I gave up the Catholic Church about 20 years ago when they told me I was living in sin when I was shacking up with a gorgeous redhead...(along with saying any kids would be "bastards" and couldn't be baptized and I would no longer be allowed to recieve sacraments and my children wouldn't be considered Christian..etc)

Yep...it's time to flog the bishop..You gotta admit though, he'll have the best sex he's ever had while in prison....

His actual charge is under the "leaving the scene of an injury accident (ARS 28-661.B). Since the individual died, it is a class 4 felony. This is punishable by multiple years in prison. Only Misdemeanors, or Class 6 felonies are eligible for probabtion or suspension of sentence.

If the police could prove that the bishop was the individual who "killed" the pedestrian, they could make it a class 3 felony. To do this, they would need to rely on his statements, forensic evidence and any eye-witness testimony. More likely, though, the DA won't bother with trying to push a Class 3, but will stick with the safer (and easier to prove) Class 4.

The manslaughter statues have nothing to do with it.

To clarify my point just a bit:

The pedestrian may be at fault for causing the collision, but that bears no weight on what the bishop was charged with.

Under Arizona statues, anyone involved in a collision, must remain at the scene and give (or attempt to give) medical attention, provide driver's license info, and registration info. There is no requirement that the police be notified, but usually that is a common practice as they can then submit a written report to ADOT and make the report available for the insurance companies. This applies to all parties involved, not just the one(s) found to be "at fault".

For any defense to claim that the colision was the fault of another party, is unrelated to what he was charged with. Had he stayed at the scene (provided he wasn't impaired by alcohol/drugs or some other substance), he wouldn't have anything to worry about. His charge is simple: Leaving the scene of an injury accident. The nature and cause of the colision are irrelevant.

FORT WORTH, Texas (June 23) - A former nurse's aide pleaded guilty to a lesser charge Monday before she went on trial on a murder charge, accused of hitting a man with her car and leaving him stuck in the windshield as she drove home.

Chante Jawan Mallard, 27, faces life in prison if convicted of first-degree murder.

She pleaded guilty to a charge of evidence tampering before attorneys began their opening statements on the murder charge.

The grisly death shocked the nation when details of the accident came to light in February 2002.

On Oct. 27, 2001, the body of Gregory Biggs, a 37-year-old former bricklayer who had been living in a homeless shelter, was found dumped in a park. Police had no leads in the case until four months later, when a tipster said Mallard talked about the incident at a party.

Police said Mallard confessed to police that her car had hit Biggs with such force that his head and shoulders jammed into the windshield and his legs were bent over the roof, his pants tearing almost completely off his body.

Instead of stopping, police said, Mallard drove about a mile down a divided six-lane highway, the man still lodged and bleeding in the jagged windshield, then continued through town to her small house in a working-class neighborhood.

She pulled into her garage, lowered the door, then sat in the car and cried, repeatedly apologizing to the man who was moaning, she later told detectives.

''Chante kept going in and out of the garage telling the man she was sorry,'' the police report states. ''She does not know how long it took the man to die; she quit going out into the garage.''

Mike Heiskell, Mallard's attorney, said last year that his client ''was simply a frightened, emotionally distraught young woman who had an accident, panicked and made a wrong choice.'' He said she is guilty only of failing to stop and render aid - not murder.

Police found the car in the garage, the seats missing and the windshield and rear glass broken. Officers said they found dark stains on the passenger-side floorboard and burned car seats in her back yard.

Two of Mallard's friends, Clete Deneal Jackson and Herbert Tyrone Cleveland, have pleaded guilty to dumping the body to help Mallard. Jackson received a 10-year sentence for tampering with evidence; Cleveland, nine years. As part of plea agreements, they were to testify at her trial.

Police initially said Biggs had lived for several days in Mallard's garage, slowly bleeding to death from his multiple fractures and cuts.

But Tarrant County Medical Examiner Nizam Peerwani later said Biggs, whose left leg was nearly amputated, probably lived only a few hours after he was hit. He could have survived if he had received medical attention, Peerwani has said.

Police, prosecutors, defense attorneys and others involved in the case have not commented about it publicly since state District Judge James R. Wilson imposed a gag order after Mallard was indicted last year.

I think the Bishop would have a bit more compassion had the guy stuck in his windshield...He would have at least given the guy last rights.. Sheesh, he's not a total monster...
