I suspect that it is because some people who sometimes get delayed for a NICS check.  For those who are either excempt from NICS checks or are in a point-of-contact state where FFL submits bgc through a state agency, it is hard to know if/when they get delayed.  When I run a NICS check, some people are what I call "instant proceed", where right after I submit the check, the next screen shows "new status" and I click "retrieve" and it shows a green proceed.  Then there is the other group, where rather than getting a "new status", it is a blue "researching".  It can sit in this state for up to 20-30 minutes now.  And then it is either a proceed or delayed, depending on whether an operator can do a manual look over and approve it within that "allowable wait" time or get dumped into the delayed bin to be worked on later.

Since the FBI runs NICS, and probably treats these differently as they know it is not for Title I stuff (the NICS website FFLs use have to put in if it is for long gun/handgun/other), the awaiting research bin for NFA is probably separate from Title I checks, and get lower priority since there is no Brady 3-day window they supposedly strive to respond within.  So these NFA delayed checks are worked on when they have time, which is probably very little given the huge amount of NICS checks run for the last 5 months.

That's my theory anyway

I’ve done a few paper individual Form 1/Form 4 but this time decided to do an eForm on an SBR because the wait time is allegedly so much shorter. Submitted eForm July 24th and still no end in sight, NFA branch can only tell me it’s delayed on the FBI side. Have been considering SBR eForm on an Aero lower I have just to see what happens.

Not a complaint, but just a note:

I submitted a cancellation request for a Form 1 that was approved, but the firearm was never assembled into an SBR.

The refund hit my bank about 50 days later.

Yes, 50 days is a long time for a refund but given the process I was impressed with how easy and efficient it was.

I know it's a small complaint cause there are guys waiting 45+ days for their stamp to arrive in the mail.

But it's been 23 days,   black Friday will be 24 days and it hasn't shown up yet.   According to nfa tracker most TX stamps show up in under 20 days.   Heck I've seen west coast stamps show up quicker and they have to mail them all the way across the country.

I efiled two Form 1's on 10/28/20 (SBR and Silencer) and got nothing back yet either (90 day wait to "research" on the silencer too). However, I was under the impression the ATF does not mail anything to you once approved via efile as the "stamp" form is only provided via the website as a .pdf file.

Edit: LOL I just got an email with my approved SBR Form 1.

If you're not pending research, and it was an SBR, then you're most likely in FBI background check purgatory. Just like I most likely will be.

You can try and contact one of your congressmen, or you can cancel and resubmit and pray you don't get delayed again.

Have you called NFA Branch?

Have you ever been delayed purchasing a firearm? Did you put your social on the Form 1?

Back in February I purchased a pair of suppressors - identical except for their serial numbers - two weeks apart.
My Wait Time for the Last one was 30 weeks.
So I'm going to say that Your Wait Time is about halfway over.

How long did voiding the stamp take? I’m assuming the refund takes longer than actually voiding. I submitted a request to void an approved stamp for an SBR the other day.

Just an FYI. I spoke with the head of the pending research dept yesterday. I mainly wanted to ask if I should/could submit some pictures of the marking on my gun to hopefully speed things up. She said they are just backlogged. They are currently on mid September forms. I submitted Oct 15 so she said I probably have about another 30 days wait before I get my cover letter.

Well called ATF today...the NFA is about 5 ish hours from me.  

Had a Sandman S pending and it was on 199 days by my count. So thought he’ll I’m off work I give the fuckers a call.

Check cashed 6/12/20.

Approved 10/7/20....STILL NO GODDAMN STAMP. When asked if he could see if it had been mailed he told me to call my FFL you know like they can do anything

It’s maddening because the last one took about 6 months from check cash and 97 days for stamp.

First stamp before that was 306 days and 37 for a stamp.

Motherfuckers.

I just sent them an email via that link. I submitted my first eForm 1 on 11/1/20 and it still says "Pending". The fingerprint cards were mailed/delivered by 11/8. Note this is my first eForm 1 and I already am no better off than if I had done a paper Form 1, which the last time I did was approved in 65 days. Lazy bastards...

Bought two suppressors from Silencer Shop with single shot trusts back in mid/late April 2020.
The pending dates from the checks being cashed are April 30th and May 19th.

Called this morning to check and I'm still pending... currently sitting at 249 & 230 days and counting.
It sure seems like EVERYONE is getting their shit back in like 100 to 175 days.

My jimmies are fuckin rustled and I'm big mad.

Anyone else sitting over 200 days with me?

You or your dealer can request a copy of the form 4 that the NFA branch keeps.  Type up a letter requesting a copy with the details of the item transferred:
1. Transferor and transferee info
2. Item details: make, model, serial number
Print it out and sign.  Then scan or take a picture of the letter and email it to:
[email protected]
With that copy, the dealer can deliver/release the NFA item to you.

Yep, I have a customer with a check cash date in late April that is still waiting for his form to come back as well.  Another one from early May.  A bunch in June and July.  Meanwhile, I've gotten forms back with check cash dates as late as mid-August.

I’ve been waiting on an eform1 for not too long but definitely longer than I’d like.  I submitted 10/10 and got this response from an examiner on why some are coming back in 20-30 days.

“The ones that are getting theirs back within 30 days are the automatic proceeds from the FBI.  I am not sure how they do their process on that.  This one was sent over to them on 10/19 and they are just starting August 3rd.”

So nothing I can do unfortunately... I guess just wait like everyone else.

I’m still waiting on my eForm 1 from July 24th, back in November I decided to see what on earth the FBI had on file for me that would cause such a delay. Paid them for a background check, sent a print card off and got my response in about a week (yes, a week) with a letterhead stating that I had no criminal history.

I’m sure they “investigate” further than that but considering I have been through this process on several NFA items in recent years why is it still such a cluster?

All of mine are eForm 1 SBR to a 1 RP trust. I submitted 2 on 11/28/2020 and 2 on 12/17/2020. No news, it's been 44 days since the 11/28 submission.

I did multiple eForm 1s late 2019 to the exact same trust with the exact same RP and it took 22 days for the approval. Nothing has changed since then.

I'm wondering what the hell is going on. I just sent an "Ask the Experts" today. Can I call to check on these like I do with paper Form 4s?

I've got two pending since March 12th.  Checked yesterday and still pending.  Sitting at over 300 days.

The frustrating part is that I've already gotten other forms back from July.  It reinforces that there shouldn't be any good reason why these are still pending when newer ones are already getting approved.  I can't help feeling like this is just sitting at some examiner's house - ready to go but just gathering dust.

I am 7 months in for F4 sent at the end of May 2020.  Dealer told me stamps from Aug 2020 are already being sent back.  The longest I have waited and not my first F4.

Finally got my Eform 1 approved, submitted 7/24/20, approved 1/25/21. Six months and a day for what was supposed to be the “quick process”. Now I’m just mad that I don’t have a real stamp.

I’m interested to see when I get the stamp for the Dead Air Mask I ordered the same timeframe, just to compare the Eform vs paper form times. I won’t be wasting more time doing the Eform SBR on the Aero now, already ordered a nice 16” upper for it.

Of course this doesn’t mean I’m not getting the Silencerco 36m the minute one comes into stock at my local shop...  NFA is a drug and I’m hooked!

I am 7 months in for F4 sent at the end of May 2020.  Dealer told me stamps from Aug 2020 are already being sent back.  The longest I have waited and not my first F4.
Will call branch tomorrow

Update: Approved January 20, 2021 so a fairly long wait ~ 240 days

OK, so bear with, how on earth do we past being stuck at FBI background check again? 6/12 pending F4 singleshot trust x2 cans, endless pending status.
